Learned AGA has accepted notice on behalf of the respondent nos.1 to 3 while Sri Siddharth Srivastava has entered appearance on behalf of the respondent no.4 .

Both may file their counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.

List this matter after six weeks.

Apart from other arguments, it is contended that it is a purely civil dispute and in fact the suit between the parties is still pending.  

Accordingly, till the next date of listing or till submission of charge sheet whichever is earlier, the arrest of the petitioners, namely Sanjai Kumar Agarwal, Kshitiz Agarwal and Hari Prakash Agarwal , who are involved in case crime no. 03 of 2014, under Sections 420, 467, 468, 441, 447 and 506 IPC  P.S. Kotwali Sadar, District Bareilly shall remain stayed of course subject to the restraint that the petitioners shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation.
