The Appellant filed an RTI application dated 18-11-2022 seeking the following information:Page 1 of 6
"मेरे द्वारा दिनाक 27/0/2022 को आपके कायागलय में एक शिकायर् पत्र भेजा गया था ( जो इस पत्र के साथ संलग्न है। उक्र् पत्र पर आपके द्वारा की गई अब र्क की कायगवाई की शलखिर् प्रमाखणर्, ववस्र्र् ृ व िस्र्ावेज जानकारी सूचना के अधिकार के र्हर् प्राथी को उपलब्ि करवाएं।"
The contents of the complaint letter dated 18.11.2022 referred in the RTI application is reproduced as under:
"ववषय : टीवी चैनल 'एड' टीवी चैनल व 'एंड' टीवी चैनल पर प्रकाशिर् हो रहे िारावादहक 'िस ू री मााँ' के खिलाफ िाशमगक भावनाएं आहर् करने और िे ि में नफरर् फैलाने का प्रयास करने के कारण शिकायर् पत्र ।
टीवी पर 20 शसर्ंबर 2022 से 'एड' टीवी चैनल पर िारावादहक 'िस ू री मााँ' प्रकाशिर् हो रहा है। उक्र् िारावादहक में दहन्द्ि ू िमग के भगवान योगेश्वर श्री कृष्णा को एक नाजायज औलाि दििाया गया है और अमयागदिर् िब्िों से सम्बोधिर् ककया गया है। भगवान कृष्णा की मााँ यिोिा को भी िो-िो िादियााँ करने वाली और एक नाजायज औलाि की मााँ के रूप में दििाया गया है । इन सब से मेरी िाशमगक भावना आहर् हुई है । इसी र्रह दिनाक 23-08- 2022 को टीवी डडबेट में नूपुर िमाग ने इस्लाम के संस्थापक पैगम्बर मौहम्मि के बारे में गलर् दटप्पणी की थी। जजसके बाि पूरे िे ि में असजकर्ा फैल गई थी और पररणाम स्वरूप उियपुर में कन्द्है यालाल की ननमगम हत्या कर िी गई थी। आज कोई भगवान ् श्री कृष्णा पर वववादिर् िारावादहक बना रहा है । कुल को कोई अशभव्याक्र्ी की आजािी की आड़ लेके पैगंबर मह ु म्मि साहब पर वववादिर् िारावादहक बना िे गा। कफर िे ि में जो अराजकर्ा फैलेगी वो कल्पना से भी परे होगी। अर्ः ननवेिन है कक 'एड' टीवी िारावादहक 'िस ू री मााँ', एक्रे स नेहा जोिी और ऐक्टर आयुि भानुिाली के खिलाफ िाशमगक भावनाएं आहर् करने और िे ि में नफरर् फैलाने का प्रयास करने के शलए कायगवाही की जाऐं । र्ाकक भववष्य में कोई ऐसा कत्य ना करें ।"
Having not received any response from the CPIO, the appellant filed a First Appeal dated 26-12-2022. The FAA order is not on record.
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:

Appellant: Absent Respondent: Shri Amrendra Singh, FAA, Shri Devender, SO and Shri Sunny Kumar Yadav, ASO appeared in person The respondent while defending their case inter alia submitted that they had already replied to the RTI application and the first appeal vide letters dated 23.12.2023 and 18.01.2023 respectively. Copies of the replies were placed on record. Further, they stated that they had filed detailed written submissions dated 22.03.2024,with a copy to the appellant, stating complete facts of the case and requested the Commission to place it on record. The relevant para of the written submission is reproduced as under:
"I. The appellant had submitted an RTI application dated 25.11.2022 seeking information relating to action taken on a complaint dated 27.10.2022. Copy of the RTI application dated 25.11.2022 is enclosed as Annexuге-1.
II. Reply dated 23.12.2023 to the RTI application provided by then CPIΟ (Shri Prateek Jain) is enclosed as Annexure - 2.
The appellant filed 1st appeal dated 02.01.2023 (Registration No. ΜOΙΑΒ/A/P/23/00001) before 1st Appellate Authority in this Ministry stating that he had not received response within the time limit in r/o his RTI application dated 25.11.2022. A copy of the 1st Appeal dated
02.01.2023 is enclosed as Annexure-3.
IV. The 1st Appeal was examined and disposed of by First Appellate Authority vide its order dated 18.01.2023. A copy of First Appellate Authority's order dated 18.01.2023 is enclosed as Annexure-4."
The CPIO's reply dated 23.12.2022 is being reproduced as under:
आपके आरटीआई आवेिन दिनांक 18.11.2022, जजसे इस मंत्रालय में दिनांक 25.11.2022 को आवेिन संख्या MOIAB/R/P/22/00501 से पंजीकृर् ककया गया है के संिभग में , यह सूधचर् ककया जार्ा है कक यह अनुभाग ननजी उपग्रह टीवी चैनलों द्वारा केबल टे लीववजन नेटवकग (ववननयमन) अधिननयम, 1995 के र्हर् ननिागररर् कायगक्रम कोड और ववज्ञापन कोड के पालन को ववननयशमर् करने वाला है।Page 3 of 6
2. आगे आपको यह सूधचर् ककया जार्ा है कक 'एंड' टीवी पर प्रसाररर् िारावादहक 'िस ू री मां' के खिलाफ आपकी शिकायर् दिनांक 27.10.2022 इस मंत्रालय में प्राप्र् हुई है , जजसे संिोधिर् केबल टे लीववज़न नेटवकग ननयम, 2021 के अनुसार ब्रॉडकास्टर 'एंड' टीबी को आवश्यक कारगवाई हे र्ु दिनाक 23.12.2022 (प्रनर्शलवप संलग्न) को भेज िी गयी है।
3. यदि आप इस उत्तर से संर्ुष्ट नहीं हैं, र्ो आप प्रथम अपीलीय प्राधिकारी श्रीमर्ी वंि ृ ा मनोहर िे साई, ननिे िक (बीसी), सूचना एवं प्रसारण मंत्रालय, िास्त्री भवन, नई दिल्ली 110 001 से इस पत्र की प्राजप्र् की र्ारीि से 30 दिनों के भीर्र संपकग कर सकर्े हैं।
Further, the Assistant Director, Ministry of Information and Broadcasting, GoI, vide letter dated 23.12.2022 has written to Managing Director of M/s Zee Entertainment Enterprises Ltd., and contents of which is being reproduced as under:
"I am directed to forward herewith a copy of the letter dated 27.10.2022 received from Shri Jai Singh complaining against telecast of a serial "Doosri Maa" on & TV channel allegedly offending religious sentiments for taking necessary action, in accordance with the Cable Television Networks (Amendment) Rules, 2021.
2. It is also requested that the decision taken on the complaint may be communicated to the petitioner directly as required under the said rules."
Thereafter, M/s Zee Entertainment Enterprises Ltd., vide letter dated 10.01.2023 disposed of the appellant's complaint and copy of the same was also provided to the appellant. The contents of the letter dated 10.01.2023 is reproduced as under:
"हमें 18 नवंबर 2022 को सच ू ना मंत्रालय को संबोधिर् हमारे टीवी िो "िस ू री मां" ("िो") के संबंि में आपका पत्र प्राप्र् हुआ है , जो हमें 23 दिसंबर 2022 को मंत्रालय से प्राप्र् हुआ है ।
हमने आपके पत्र की सामग्री का अध्ययन ककया है और हम स्पष्ट करना चाहर्े हैं कक यह िो एक कजल्पर् िो है जो पाररवाररक और सामाजजक संबंिों के ववशभन्द्न पहलुओं को धचत्रत्रर् करर्ा है और ककसी भी र्रह से भगवान कृष्ण पर आिाररर् नहीं है ।
हम आपको सधू चर् करना चाहें गे कक िो में एक बाल चररत्र है जजसका नाम 'कृष्ण' है। अपने िभ ु ागग्य के कारण, जब कृष्ण केवल 9 वषग का होर्ा है , र्ो उसकी मां माला अस्पर्ाल में मर Page 4 of 6 जार्ी है। 'यिोिा' नाम के इस िो की नायक एक बहुर् ही प्यार करने वाली, िे िभाल करने वाली और बड़े दिल वाली मदहला है जो एक सामाजजक कायगकर्ाग है। िो की कहानी के अनुसार, हम दििार्े हैं कक यिोिा भी कृष्ण के साथ उसी अस्पर्ाल में मौजूि है , जब कृष्ण की मां का ननिन हो जार्ा है और कृष्ण को इर्ना दिल टूटर्ा िे ि, यिोिा र्ुरंर् उसके प्रनर् मााँ के प्यार से भर जार्ी है और वह उसे अपने प्यार और िे िभाल में ले जार्ी है। जीवन के कुछ उर्ार-चढावों को रचनात्मक रूप से धचत्रत्रर् करने के शलए, हमें उन जस्थनर्यों को दििाना होगा जो जीवन की कठोर वास्र्ववकर्ा हैं जैसेः कृष्ण अपने बचपन में अपनी जैववक मां को बहुर् जल्िी िो िे र्े हैं, या अपने जैववक वपर्ा के बारे में नहीं जानर्े हैं। लेककन हम एक बार कफर स्पष्ट करना चाहर्े हैं कक हमारा इरािा ककसी भी र्रह से आपकी िाशमगक भावनाओं को आहर् करने या अपमाननर् करने का नहीं है। िो के माध्यम से. हमारा प्रयास यह दििाना है कक भले ही एक बच्चे को अपनी जैववक मां या वपर्ा से प्यार न शमले, लेककन 'यिोिा' जैसा एक अच्छा इंसान कृष्ण को त्रबना िर्ग प्यार और स्नेह िे सकर्ी है और हमारा एकमात्र इरािा एक बच्चे और िे िभाल करने वाली मदहला के बीच साझा ककए गए सुंिर संबंिों को धचत्रत्रर् करना है जो जैववक मां नहीं र्ो भी मां की र्रह है।
आप इस बार् की भी सराहना करें गे कक जो कहानी, कफल्म, िो या नाटक के रूप में धचत्रत्रर् ककया जार्ा है , वह कलात्मक उपचार के रूप में अशभव्यजक्र् की स्वर्ंत्रर्ा के अधिकार से संरक्षिर् होर्ा है। इस प्रकार, जब एक उधचर् व्यजक्र् के लेंस से िे िा जार्ा है , यानी, कानन ू द्वारा स्थावपर् मानक, िो कायगक्रम संदहर्ा सदहर् लागू कानून का पालन करर्ा है और हम आपको आश्वस्र् करना चाहर्े हैं कक उपयक् ुग र् िो सदहर् हमारे सभी िो हमेिा बीसीसीसी कोड का पालन करर्े हैं। हमें उम्मीि है कक आपकी धचंर्ा का समािान हो गया है और हम आपको ननरं र्र संरिण की उम्मीि करर्े हैं। यदि आप उपरोक्र् उत्तर से संर्ुष्ट नहीं हैं, र्ो आप 15 दिनों के भीर्र [email protected] बीसीसीसी के साथ अपील िजग कर सकर्े हैं।
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of the records, notes that the respondent has replied the RTI application in toto vide letter dated 23.12.2022 and also the complied with the First Appellate Authority order dated 18.01.2023 wherein it was informed that his complaint has been forwarded to the Broadcaster and TV for necessary action in accordance with the Cable Television Networks (Amendment) Rules, 2021 vide his letter dated 23.12.2022. Thereafter, outcome of the complaint was intimated to him by M/s Zee Entertainment Enterprises Ltd., vide letter dated 10.01.2023. It was also informed that the appellant can file an appeal before BCCC, if he is aggrieved with the disposal of Page 5 of 6 his complaint. The respondent has informed during the hearing that they had 3 tier grievance redressal mechanism consisting of Broadcaster as first tier, SRB (Self-Regulatory Body) as second tier i.e. BCCC in this case; and third tier in the form of Governments' Inter Departmental Committee. The appellant neither filed any written objection nor presented himself before the Commission to controvert the averments made by the respondent and further agitate the matter. The submissions of the respondent were taken on record. The Commission finds that appropriate reply has been given by the respondent and interference from the Commission is not called for in this case.
The appeal is disposed of accordingly.
