                                     ORDER

The appellant Shri Ghayn Prakash Verma submitted RTI application dated 25.09.2014 to the Central Public Information Officer, Life Insurance Corporation of India, Kanpur seeking information in respect of six cheques issued by the LIC of India, copies of applications, the name and pay scale of the employee who prepared the vouchers; copies of surrender applications etc. through seven points.

2. The CPIO vide letter dated 21.10.2014 denied information under the provisions of Section 8(1)(h) of the RTI Act, 2005 on the grounds that the matter was being investigated against him. Dissatisfied with the reply of the CPIO, the appellant filed an appeal on 30.10.2014 before the first appellate authority (FAA). The FAA vide order dated 12.11.2014 concurred with the decision of the CPIO.

3. Thereafter the appellant filed the present appeal before the Commission.

4. The matter was heard by the Commission. The appellant stated that the respondents denied the documents as sought for, which were required by him in order to defend him in the disciplinary proceedings. The respondents stated that the matter was still going on against the appellant and cannot be provided to him. The appellant can seek the documents mentioned in the charge sheet from the Inquiry Officer during the proceedings.

5. The Commission accepts the submissions of the respondents and upholds their decision. The appeal is disposed of.
