ORAL  ORDER:
Per Justice Mr.S.B.Mhase, Honble President   This matter was on board and the notice of final hearing was issued by the Commission fixing the date 13/10/2009. On that date respondent was present.  However, appellant was not present. Therefore, we adjourned the matter on 18/11/2009.  On that date also respondent/org.complainant was present and appellant was not present.  Therefore matter was adjourned to today.  Today also none is present on behalf of the appellant. Respondent no.1 is present.  Under these circumstances we pass following order:-
                                      ORDER
1.    

Appeal stands dismissed for non prosecution. 

2.     In view of the appeal is dismissed for default, original complainant is at liberty to make an appropriate application for execution and for withdrawal of the amount, if deposited by the appellant in the District Consumer Forum.
