1. Adv. Jayant Chitnis appeared for appellants' no. 1 to 34. Adv. P. R. Adkine present for respondent. Adv. Chitnis filed application for withdrawal of this appeal. According to him this appeal is filed by the 34 appellants who are complainants in 34 complaints. As the judgment in all the 34 complaints were passed by common judgment, the single appeal was filed. Adv. Chitnis submitted that, as earlier the appeal was filed and earlier also Appeal No. 2651/2005 decided on 12.03.2010 was filed by LIC against the common judgment and order in separate complaints, thus appeal was filed.
2. However on earlier date heard Adv. Chitnis for appellant and Adv. N. R. Bhavar for respondent. On last date Adv. Bhavar raised objection about tenability of this appeal as this appeal is by several complaints and the order passed by common judgment by the District Forum. According to him though the judgment and order passed by the Forum is common the appellants being separate complainants, and hence the objection was raised by Adv. Bhavar for respondent. Adv. Chitnis by this application wants to withdraw the appeal no.
255/10. He further contended that, the appellants are intending to file the separate appeals. However, we are of the view that, the appellants are at liberty to make party to the complaints decided by common judgment and order and are at liberty to file the appeals subject to the limitation. The matter as where the period which is extend existing in the filing the present appeal is to be excluded in counting the period of limitation at the time of considering application if any filed by the present appellants filed in case before the appeal. Hence, O R D E R
1. Appellants are allowed to withdraw the appeal.
2. In the circumstances parties to bear their own cost.
