1. This hearing has been done through hybrid mode. CM APPL. 25140/2023 in W.P.(C)-4064/2023
2. This is an application seeking extension of time for depositing the amount of Rs.1 crore in terms of the order dated 29th March, 2023. Vide the said order, this Court had granted liberty to the Petitioner to pay the amount of Rs.1 crore by 10th April, 2023 in the following terms:
"7. Considering the nature of the order which has been passed by the TDSAT, the petition, along with all pending applications is disposed of with the direction that if the Petitioner shows its bona fides and pays a sum of at least Rs.1 crore by 10th April, 2023, to the Respondent No.2 herein, the Petitioner is free to move an application before TDSAT seeking recall of the directions passed in the operative portion of the order dated 21st March, 2023. The matter shall then be considered by TDSAT on the next date i.e, 11 April th 2023. If the payment of the said amount is not made by Signature Not Verified Digitally Signed By:RAHUL Signing Date:16.05.2023 15:46:53 10 April 2023, the order of the TDSAT dated 21 th st March 2023, shall come into operation."
3. As on date, the submission of the Petitioner is that Rs.1.11 crores have been paid by 12th May, 2023. Mr. Nazir Husain, ld. Counsel confirms payment of Rs.1.01 crores. Be that as it may, the fact that Rs.1 crores has been paid is not disputed anymore. In view of the same, the extension as sought is granted till 1st May, 2023.
4. The matter is stated to be listed before TDSAT on 18th May, 2023. Let the TDSAT now consider the matter in respect of the remaining payments.
5. The application is disposed of in these terms.
