Shri Arihant Kumar Nahar, learned counsel for the petitioner.
In compliance of the order dated 02.11.2022, notice has been served
upon the respondent No.1 by Humdast mode. Receipt along with the
affidavit has been filed and the same is on record.
Despite receipt of Humdast notice, no one is appearing on behalf of the respondent No.1.
Heard learned counsel for the petitioner on admission as well as for grant of interim relief.
Shri Nahar submitted that bid of the petitioner has been rejected at the stage of opening of technical bid. Vide e-mail dated 27.10.2022, it has been informed about the reason of rejection, that the petitioner has not submitted completion certificate. Shri Nahar has further pointed out that the said certificate had already been submitted which is at page No.151 of the writ petition (at page No.26 of the bid document). He further submitted that financial bid has been opened and the rate quoted by the petitioner is below 50 lacs from L-1.
It is directed that till the next date of hearing, work order be not issued to L-1.
Let process fee be paid for issuance of notice to the respondent Nos.1 to 5 for RAD mode.
Notice be made returnable within 2 weeks. List on 24.11.2022.
