UPON hearing the counsel the Court made the following
O R D E R

This matter has been listed before this Court today but the office report has not been sent. The Ld. Counsel for the petitioner submits that he wants to withdraw the present petition. Let it be processed for listing before the Hon'ble Court.

Submissions have been made on behalf of the respondents to file vakalatnama and counter affidavit and submissions have also been made by some of the respondents to supply complete set of pleadings. It is evident from the record that opportunity to respondent Nos.1, 9, 11, 17, 19, 23 to 27, 29, 30, 31, 34 and 38 for filing counter affidavit has already been declined vide order dated 16.11.2016.
The respondents who are now entering appearance need to file vakalatnama within two weeks and in case stipulated time to file counter affidavit has not expired they can file counter affidavit within four weeks. Complete set of the pleadings be supplied to those respondents, who have not been supplied copies of the pleadings till date with proof of service of pleadings within two weeks. Thereafter four weeks time is granted to file counter affidavit.
The Ld. Counsel for respondent No.8 submitted that as per his information, it was communicated to respondent No.8 that there are certain defects in the counter affidavit and he is Item No.63 -4- not sure whether the defects have been removed or not and in case defects have not been removed, the defects can be removed within four weeks.
List again on 7.12.2017.
