This matter was heard on 02.02.2010 in the presence of both parties. Appellant was present in person, along with Shri Puran Chand Tamta. Respondents were represented by Shri Anand Prakash, Director (RT), North and Shri D.K. Panda, Section Officer.

2. It was submitted on behalf of the respondents that the queries which appellant had raised in his RTI-application dated 05.08.2008 related to the Association of State Road Transport Undertaking (ASRTU), which was not a public authority within the meaning of Section 2(h) of the RTI Act.

3. Matter is remitted back to the Appellate Authority, Shri Saroj Kumar Dash, Joint Secretary (Transport & Admn.) with the direction to him to examine in consultation with the parties concerned, (a) whether ASRTU was a public authority and (b) in case it was concluded after hearing the parties that ASRTU was not a public authority, whether either all or a part of the information requested by the applicant can be collected from ASRTU by the respondents under Section 2(f) of the RTI Act as clarified in the decision of the Delhi High Court in its decision in Poorna Prajna Public School Vs. Central Information Commission; W.P. (C) No.7265 of 2007; Date of Decision: 25.09.2009.

4. Time for disposal ⎯ 4 weeks.

5. Appeal disposed of with these directions.

6. Copy of this direction be sent to the parties.
