UPON hearing the counsel the Court made the following
O R D E R
1. The petitioner seeks his enlargement on regular bail in FIR No.0129 dated 31.05.2022 under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station City Malout, District Sri Muktsar Sahib.
2. Signature Not Verified The allegations pertained to recovery of 50 grams of Heroin Digitally signed by ARJUN BISHT Date: 2024.01.29 from the petitioner. He was taken in the custody on 31.05.2022. It 18:04:13 IST Reason:
being a case of non-commercial quantity, ordinarily, we would have 1 released him on bail, however, it seems that the petitioner is a habitual offender. He was earlier involved in four cases under the NDPS Act and has been convicted in two of such cases.
3. On a query, learned State counsel informs that the trial has commenced and three witnesses have already been examined.
4. In the peculiar facts and circumstances of this case, we are not inclined to release the petitioner on bail, at this stage. Rather, we deem it appropriate to direct the Special Judge, Sri Muktsar Sahib to make an endeavour to conclude the trial within six months. If the trial is not concluded within six months, the petitioner shall be at liberty to revive his prayer for bail.
5. The special leave petition is disposed of in the above terms.
6. All pending applications, if any, also stand disposed of.
