OFFICE REPORT The matters above mentioned have been filed against the Judgment and Order dated 21st October, 2011 passed by the High Court of Judicature at Madras in A. S. No. 811 of 2008.

IN CIVIL APPEAL NO. 3015 OF 2013 It is submitted that there are two respondents. Respondent Nos. 1 and 2 are represented through M/s. Gautam Narayan & Mr. Vijay Kumar, Advocates respectively.

It is further submitted that Ms. V. Mohana, Advocate has been designated as Senior Advocate. Notice for alternative arrangement in respect of the appellants has been issued on 8th August, 2015 but neither A. D. Cards nor unserved covers containing notices have been received.

IN CIVIL APPEAL NO. 3016 OF 2013 There are eight respondents. Respondent No. 1 is represented by Mr. Gautam Narayan, Advocate. Ms. V. Mohana, Advocate has been designated as Senior Advocate. Notice for alternative arrangement in respect of respondent nos. 2 to 8 has been issued on 8th August, 2015 but neither A. D. Cards nor unserved covers containing notices have been received.

Service of notice is incomplete in both the matters.

It is further submitted that counsel for the parties have not filed statement of case and in terms of Order XIX Rule 32(2) Supreme Court Rules, 2013, and its proviso, where a party does not file statement of case within the time prescribed, it shall be presumed that the parties do not desire to file statement of cases and they have adopted list of dates/synopsis as statement of cases in both the matters.

The matters above mentioned are listed before the Hon'ble Court with this office report.
