Heard Sri Rajesh Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for the respondent.
Submission of learned counsel for the petitioner is that fair price shop license of the petitioner has been cancelled by means of the order dated 01.02.2023. The petitioner had preferred an appeal under Clause 13(3) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order 2016 on 22.02.2023 alongwith the application for interim relief, which has been rejected by means of the order dated 03.03.2023, which has been assailed in this petition. The case is now listed on 24.04.2023. However, after arguing at some length, learned counsel for the petitioner restricted his prayer for a direction for disposal of appeal of the petitioner within the time frame as provided under Clause 13(3) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order 2016. To which there is no objection by the other side.
In view of above, without entering into the merits of the case this petition is disposed of providing herein that the appeal filed by the petitioner bearing No.D-037 of 2023(Dhirendra Kumar versus State of U.P. and another) shall be disposed of by the opposite party no.2/ Joint Commissioner 'Food', Lucknow Division,Lucknow expeditiously within a period of four weeks from the date of production of certified copy of this order.
