1. Upon coming of the instant contempt petition for consideration today, Mr. Khawaja Amicus invited the attention of this Court to Rule 6(7) of the Rules to regulate the proceeding for contempt of High Court of Jammu and Kashmir and Ladakh and Subordinate courts, 2023 framed under the Contempt of Courts Act of 1971 and issued vide notification no. 2520/2023 and would submit that the present contempt proceedings/Robkar has to be dealt with in accordance with the provisions of Section 14 of the contempt of courts Act 1971 by this bench alone, in that, the contemnor has not invoked the provisions of Sub-Section 2 of Section 14.
There appears to be substance in the submissions made by Mr. Khawaja, as such, the matter is taken up for consideration. Heard and considered the matter.
2. The contemnor present in the Court at the very outset tenders an unconditional apology expressing as remorse and regret for having obstructed the court proceedings and would submit that the said conduct was not intentional or deliberate but bonafide on account of pendency of arbitration proceedings of the department being simultaneously held with the contempt proceedings conducted by the court.
3. Since the power of contempt vested in this Court has to be exercised with great care and caution therefore, having regard to the remorseful apology tendered in the open court by the contemnor, this Court in the interest of justice and keeping in mind the magnanimity in mind accepts the apology tendered by the contemnor and consequently drop the proceedings against the contemnor.
4. Robkar accordingly, shall be deemed to have closed with the observations that the contemnor shall hereafter remain careful while appearing before the court and also show great respect for the court orders whenever served upon him.
