ORAL ORDER
5 09-07-2013As some legal issues have cropped up with regard to maintainability of these petitions which requires analogous Patna High Court Cr.Misc. No.14629 of 2010 (5) dt.09-07-2013 5 hearing and for that, at the request of the learned counsels of the respective petitions, the matter is posted on 15.07.2013. The points to be addressed are:-(i) Whether Miscellaneous Petition will suffice for consideration relating to cancellation of bail or the order impugned is to be challengeable under Appellate/Revisional Jurisdiction, (ii) Because of the fact that in terms of Section 439(2) of the Cr.P.C. the High Court as well as Court of Sessions enjoins concurrent jurisdiction, in the aforesaid background whether it is justifiable to approach High Court overlapping the jurisdiction of Sessions Judge contrary to the judicial pronouncement so made relating to anticipatory bail as well as regular bail directing the petitioner to approach Court of Sessions first.
Office is directed to list all cases relating to cancellation of bail as possible so that it could be decided once for all relating to maintainability.
