Heard the learned Advocates appearing on behalf of the parties. Perused the case diary.

The petitioner is in custody for 9 years and 3 months. Out of 48 witnesses, till date, only the examination of 7 witnesses is complete and out of 13 chargesheeted accused persons, 12 are on bail.

Now, considering the petitioner's length of detention in custody and the progress of the trial, more particularly when other co- accused persons are on bail, we allow the petitioner's prayer for bail.

Let the petitioner be released on bail upon furnishing a bond of Rs.50,000/- with two sureties of Rs.25,000/- each, both of whom must be local, to the satisfaction of the learned Chief Metropolitan Magistrate, Calcutta and on further condition that after release, the petitioner shall not leave the jurisdiction of New Market Police Station except for the purpose of attending the court proceeding and report to 2 the investigating officer of the case thrice in every week until further order.

It is further directed that he shall attend the day-to-day court proceeding and if it is found that he does not attend the court on any of the occasion without any justifiable reason, the court below shall have the liberty to cancel his bail and take him into custody without any further reference to this Court after giving him a reasonable opportunity of hearing.

The application for bail is, thus, disposed of.
