This petition has been moved by Jagbir Singh under Section 482 of the Code of Criminal Procedure read with Section 3(1)(d) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 seeking extension of his parole on the ground that his wife is lying seriously ill after her recent delivery.

The brief facts giving rise to this petition are that the petitioner was released on emergency parole to look after and assist his wife during delivery. Ultimately, he was blessed with a female baby. Unfortunately, the health condition of his wife started deteriorating after delivery due to continuous bleeding in the PPH. She has to be admitted in a private hospital for her treatment. She was advised bed rest. Now her health condition is not improving. She is still under treatment and requires complete course of treatment and rest. She needs personal attendant and the services to look after her. In these premises, the respondents may be Criminal Misc. No.M-6927 of 2009 (O&M) -2- directed to extend the emergency parole of the petitioner for four weeks.

I have heard the learned counsel for the petitioner, besides perusing the record with due care and circumspection.

Learned counsel for the petitioner submitted with full force that as is borne out from Annexure P.1 purportedly issued by Jeewan Dhara Hospital, Dholi Pyau, Kithwari Road, Palwal, the wife of the petitioner has been advised complete bed rest at least for one month for the reason that after delivery her bleeding is not stopping, there being none to look after her, the parole granted to the petitioner may be extended.

I have given a deep and thoughtful consideration to this submission. In Annexure P.1, it has been mentioned that Hysetecto injection should be done if bleeding does not stop. Of course, the wife of the petitioner has been advised bed rest, but there is nothing on the record to show that there is none else in the family to look after her. If the bleeding does not come to stop, merely the afore-mentioned injection is to be administered to her. Thus, to my mind, prima-facie no case is made out for extension of parole period. Consequently, this petition is dismissed.
