No., SI (VII) - 236/2025 (AIU) dated 22.10.2025 u/s 20(b) and 23(a) read with Section 8 of the NDPS act, 1985.

In the matter of : Bablu Kumar ... Petitioner(s) Md. Sarwar Jahan Ms. Tapati Sarkar Mr. Vinay Verma ... for the Petitioner(s) Ms. Arushi Rathore ... for the Union of India Mr. Bhaskar Prosad Banerjee Ms. Sretapa Sinha ... for the Customs A compliance report has been submitted by the prosecution.
The petitioner has returned to the correctional home on 13.04.2026 after the period of parole was over.
The records of the case reflect that the interception was at the Airport and the petitioner is a resident of Jharkhand. Primarily, it reflects that the petitioner along with others is using the Calcutta Airport as a corridor for carrying narcotic substances.
Having regard to the same and the fact that large number of the cases being found in the Calcutta Airport for bringing contraband from foreign country, I am of the 2 opinion whether the recovery is of intermediate or commercial quantity is irrelevant. This case involves import of contraband from the foreign country.
Having considered the heinousness of the crime, I am not inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Rejected.
Accordingly, CRM (NDPS) 687 of 2026 is dismissed. Report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
