ORDER
1. In this original application, the applicant has raised a grievance against illegal felling of trees at Greater Kailash Enclave, Part B, Gate No. 5, New Delhi 110048.
2. The applicant has alleged that the said illegality has been committed by Respondent No. 12. Further grievance has been raised by the applicant against the illegal construction being raised by the said respondent but the issue of illegal construction per se, without involving any environmental issue does not fall within the jurisdiction of the Tribunal.
3. So far as, the issue of illegal felling of trees is concerned the applicant alleges that about 8 to 9 trees have been illegally cut from the site, but in support of such a plea, no material has been placed on record. The photographs which have been placed on record by the applicant only depict some construction being raised at the site in question.
4. The provisions of the Delhi Preservation of Trees Act 1994 are applicable in this case wherein the Tree Officer has been empowered to take 1 action for such violation. The Tree Officer has been defined under the Act and he has been conferred with the power to preserve trees within his jurisdiction and to grant permission and take action in case, if any violation takes place. The Tree Officer has been conferred even with the power to seize the property under Section15 of the Act, the power to arrest without warrant under Section 18 of the Act.
5. Hence, the applicant is required to file a complaint before the Tree Officer, in accordance with law and enclosing therewith all the supporting material.
6. Thus, we dispose of the O.A., permitting the applicant to file an appropriate complaint before the Tree Officer in accordance with law. If such a complaint is filed by the applicant, the same will be duly considered by the Tree Officer as per the procedure prescribed under the Delhi Preservation of Trees Act 1994 as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of the complaint.
7. O.A. is accordingly disposed of.
