In re: An application for bail under Section 439 of the Code of Criminal Procedure filed on February 7, 2014 in connection with Kaliganj Police Station Case No. 370 of 2013 dated May 23, 2013 under Section 365 of the Indian Penal Code, 1860 subsequently added Section 376 of the Indian Penal Code.
And In the matter of: Imran Sk. alias Iman Sk. and Anr. ...Petitioners.

Heard the learned advocates appearing on behalf of the respective parties.
The petitioners are seeking bail in connection with a case relating to offences punishable under Section 365 of the Indian Penal Code, 1860 and subsequently added Section 376 of the Indian Penal Code.
It is submitted by the learned advocate for the State that the investigation is complete.
Having considered the case diary and the materials on record and, particularly, when the petitioners are in custody for more than 50 days, and the investigation is complete, we are of the opinion that further detention of the accused/petitioners is not necessary.
Therefore, the accused/petitioner no.1., namely, Imran Sk. alias Iman Sk, and the petitioner no.2, namely, Feron Mallick, be released on bail upon furnishing a bond of Rs.5,000/- (Rupees five thousand) only each with two sureties of like amount, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate at Krishnagar District: Nadia, on conditions that the petitioners shall not enter the territorial jurisdiction of the Kaliganj Police Station, and the petitioners shall attend the court on each and every occasion unless prevented by sufficient cause, and after 2 their release, they shall disclose their whereabouts to the concerned police station.
The application for bail is, thus, allowed.
