JASWANT SINGH, J(ORAL) Prayer is for suspension of sentence on behalf of applicant- appellant who has been convicted and sentenced to undergo rigorous imprisonment for a period of ten years with fine of Rs.1,00,000/- and in default of payment of fine he is further directed to undergo rigorous imprisonment for two years for an offence punishable under Section 21 of the Narcotics Drugs and Psychotropic Substances Act.

The appeal has already been admitted.

Crl.Misc. No.54147 of 2010 #2# Learned counsel for the appellant submits that the appellant is in custody for the last six years two months and 23 days. He further submits that the case of applicant-appellant is duly covered by the judgment rendered by this Court in case of "Daler Singh Vs. State of Punjab 2007(1)RCR (Criminal) 316".

Learned State Counsel has placed on record custody certificate of the applicant-appellant which reveals that he has undergone custody period of five years ten months and 22 days. He concedes that the matter is covered by Daler Singh's case (supra).

Keeping in view the custody period and the fact that the appeal is not likely to be heard in near future, the sentence of the applicant-appellant Mangal Singh @ Manga @ DC is suspended. It is ordered that applicant-appellant Mangal Singh @ Manga @ DC be admitted to bail subject to the satisfaction of the CJM/Duty Magistrate, Amritsar.
