HON'BLE MR. JUSTICE KULDEEP MATHUR Order 19/12/2022 Heard. Perused the material available on record. The convict petitioner Jogaram S/o Shri Ruparam has been granted regular parole of seven days by District Level Parole Advisory Committee, Jodhpur vide recommendations drawn in its meeting held on 20.09.2022 whereby he has been directed to furnish a personal bond in the sum of Rs.50,000/- and two sureties in the sum of Rs.25,000/- each (duly verified by Tehsildar concerned) as a pre-requisite condition for being released on parole. The convict-petitioner has approached this Court by way of this writ petition seeking waiver of the condition of furnishing surety bonds owing to his poor financial position. (2 of 2) [CRLW-498/2022] In compliance of the order dated 06.12.2022, learned AAG Shri Joshi has furnished the factual report as per which the petitioner has satisfactorily availed first, second and third paroles on furnishing personal bonds. The report also revels that the conduct of the petitioner in jail is satisfactory.

Having regard to the overall facts and circumstances of the case and the fact that by effect of the orders passed by this Court in D.B. Criminal Writ (Parole) Petition Nos.4311/2014, 56/2019 and 245/2020, the petitioner has satisfactorily availed first, second and third paroles on furnishing personal bond only without any complaint whatsoever, we deem it proper to release the petitioner on regular parole of seven days by waiving the condition of furnishing two surety bonds as imposed by the District Parole Advisory Committee, Jodhpur and it is directed that the convict petitioner Jogaram S/o Shri Ruparam shall be released on regular parole of seven days upon his furnishing a personal bond in the sum of Rs.50,000/- to the satisfaction of Superintendent, Central Jail, Jodhpur. However, the other conditions of the order dated 23.09.2022 qua the convict petitioner are maintained.

The writ petition is disposed of accordingly.
