Order 11/05/2022 This writ petition has been filed by the petitioners seeking to question the discontinuance of the petitioners from NPCDCS programme w.e.f. 1.5.2020 and seeking direction to the respondents to continue the services of the petitioners in terms of letter/communication dated 29.04.2021 (Annex.9) in the NPCDCS programme continuing through Mission Director/Commissioner, National AYUSH Mission.
By order dated 14.02.2022, it was noticed by the Court that the respondent No. 3-Union of India filed its reply to the writ petition placing the onus on the State Government to continue with the Scheme.
When the respondent-State was directed to indicate its stand, a response has been filed on behalf of the respondent Nos. 5 and 7, inter alia, indicating that the project concerned has come to an end and that the Ministry of AYUSH has not indicated the intention to continue the services of the petitioners.
Further submissions have been made that so far as the proposition with regard to continue the petitioners in the similar Schemes operated by the State Government is concerned, the respondents do not wish to hire petitioners directly in those projects and that they would be following described procedure in case of requirements.
In view of the above fact situation, wherein admittedly, the project initiated wherein the petitioners were engaged has come to an end, the Union of India has put the onus on the State Government and the State Government on its part has indicated (Downloaded on 11/05/2022 at 09:05:31 PM) (13 of 13) [CW-7369/2021] that for the present, they do not intend to continue with the project in its present form, no case for interference in the present petitions in respect of the reliefs claimed by the petitioners is made out, the petitions are, therefore, dismissed.
The petitioners would be free to approach the respondents for any relief with regard to seeking preference in the case, the scheme/project is relaunched.
