1. By this petition filed under Article 226 of the Constitution of India, the petitioner seeks to set aside the order dated 1.9.2001 passed by the learned ADJ and order dated 19.6.2001 passed by the learned Estate Officer.

2. Brief facts of the case relevant for deciding the present petition are that the petitioner was allotted government accommodation bearing quarter No. 875, Sector V , R.K Puram , New Delhi while working in the Department of Lighthouses and Lightships, Ministry of Shipping Transport. Thereafter the department was shifted to Noida and the allotment of the petitioner was cancelled on the ground of transfer and a show cause notice dated 3.5.2001 was served upon him. Thereafter an eviction order dated 19.6.2001 was passed against him, against which the petitioner preferred an appeal which vide order dated 1.9.2001 was dismissed. Feeling aggrieved with the above said two orders, the petitioner has preferred the present petition.

Counsel for the petitioner submits that the petitioner cannot be treated as an unauthorized occupant in respect of the Government accommodation which was allotted to him by the respondent while he was working in Delhi being an employee of Department of Lighthouses and Lightships. Counsel further submits that Noida being a part of the NCR cannot be treated as an outstation and is an extended part of the Union Territory of Delhi and therefore, the petitioner was entitled to retain the government accommodation of the general pool which was allotted to him while working in Delhi. Counsel states that Noida office of the petitioner is situated within a radius of 20 K.M. from Delhi. Counsel also submits that neither the C.A.T had any jurisdiction to decide the controversy in question nor this court had jurisdiction to decide the petition and thus the order dated 19.1.2001 passed by the C.A.T and the order dated 28.2.2001 passed by the Hon’ble Division Bench of this court in W.P.(C) No. 1329/2001 are without jurisdiction. Counsel also submits that no accommodation has been provided to the petitioner at Noida as no accommodation is available to the Department at Noida. In support of his arguments, counsel for the petitioner has placed reliance on the following judgments:-

4. Opposing the present petition, Mr. A.K. Bhardwaj, counsel for the respondent submits that the present petition filed by the petitioner is a gross abuse of the process of law as he had earlier invoked the jurisdiction of the Central Administrative Tribunal challenging the cancellation order dated 4.11.99 and vide order dated 19.1.2001 the Tribunal dismissed the said petition filed by the petitioner. Counsel also submits that the said order has attained finality as the petitioner had challenged the order of the Tribunal before the Hon’ble Division Bench of this court and vide order dated 28.2.2001 the Hon’ble Division Bench also dismissed the writ petition of the petitioner and therefore, now the petitioner cannot be allowed to challenge the same cancellation order before this court. Counsel also states that the judgments as cited by the counsel for the petitioner are not applicable to the present case as the Tribunal was well within its jurisdiction to adjudicate the challenge made to the cancellation order. Counsel also submits that the jurisdiction of the Tribunal is barred after the proceedings are initiated under the P.P.Act and if any order of eviction is passed by the Estate Officer under Section 5 of the Public Premises Act then the remedy available to the party would be to invoke Section 9 of the Public Premises Act. Counsel also submits that O.M. dated 15.9.1999, on which reliance was placed by the petitioner, cannot come to the rescue of the petitioner as under the said O.M. it was made clear that the said Department of Light Houses and Light Ships will not be considered an eligible office for further allotment from General Pool. Counsel thus states that the said Department in their letter dated 3.7.2002 has not taken care of the language of the said Memorandum and in piecemeal has taken note of the fact that the said Department of Light Houses and Light Ships was made ineligible for any further allotment from General Pool accommodation. Counsel also submits that Noida being in a separate State i.e. State of Uttar Pradesh, the petitioner cannot have the benefit of retaining the accommodation in Delhi on the said distance theory of 20 K.M.

5. I have heard learned counsel for the parties.

6. The petitioner was allotted a Government accommodation i.e. Quarter No. 875, Sector V, R.K. Puram, New Delhi by virtue of his employment with the Department of Lighthouses and Lightships, Ministry of Shipping Transport. The said accommodation was allotted by the Government from its general pool. The said Department of Lighthouses and Lightships shifted from New Delhi to Noida w.e.f. 12th August, 1999 and the Directorate of Estates vide their office memorandum dated 15.9.99 issued directions that the said Department of Lighthouses and Lightships will not be considered as an eligible office for further allotment of general pool accommodation in Delhi w.e.f. 12.8.98. A list of employees, who were in occupation of the general pool accommodation of the Central Government, was also forwarded by the Directorate of Estates to the said Department of Lighthouses and Lightships and the name of the present petitioner was enlisted at serial No. 11 of the said list. As a result of the said office memorandum, the allotment of the Government accommodation in favour of the petitioner was cancelled by the Directorate of Estates vide their letter dated 4.11.1999 and the petitioner was directed to hand over the vacant possession of the said Government quarter to the CPWD. Feeling aggrieved with the said cancellation order, the petitioner challenged the same by filing a petition before the Central Administrative Tribunal which was dismissed by the Central Administrative Tribunal vide orders dated 19.1.2001. The order of the Central Administrative Tribunal was then challenged by the petitioner by filing a civil writ petition No. 1329/2001, which was dismissed by the Hon’ble Division Bench of this Court vide orders dated 28.2.2001. On the other hand notice under Section 4 (2) (1) (b) (ii) of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 was issued by the Estate Officer. The petitioner had appeared before the Estate Officer and filed his reply dated 25th May, 2001 and the Estate Officer vide orders dated 19.6.2001 passed an eviction order against the petitioner under sub Section (i) of Section 5 of the Public Premises Act. The said eviction order was challenged by the petitioner before the learned District Judge by filing an appeal under Section 9 of the Public Premises Act and vide orders dated 1.9.2001 the same was dismissed. The main ground taken by the counsel for the petitioner in the present petition is that the petitioner is not an unauthorized occupant of the said Government accommodation as the Noida office of the Department is located just within a radius of 20 Kms of New Delhi. The contention of counsel for the petitioner is that the shifting of office within a radius of 20 Kms cannot be termed as a transfer. Counsel also contended that an employee is not even entitled to a transfer allowance if the journey on transfer is within the same station or to a station of a distance of not more than 20 Kms. Counsel for the petitioner has also given a feeble explanation for invoking the jurisdiction of the Central Administrative Tribunal and then the writ Court by saying that it was done under the ill advice of the then counsel representing the petitioner.

7. Mr. A.K. Bhardwaj, counsel for the respondent on the other hand took a strong objection to the maintainability of the present petition as the petitioner has already exhausted his remedy of challenging the cancellation order before the Central Administrative Tribunal and also before the writ Court. This Court finds merit in the argument of counsel for the respondent. The accommodation was allotted by the Government from its general pool when the office of the petitioner was located within the jurisdiction of Delhi. Once the office itself shifted from Delhi to Noida then how could the petitioner retain the accommodation in Delhi. The argument of counsel for the petitioner that the Noida office is located within a radius of 20 Kms of New Delhi is not only devoid of any merit but is preposterous on the very face of it. Noida is a part of adjoining State bordering Delhi i.e. Uttar Pradesh and, therefore, by no stretch of logic in the absence of any policy of the Government, the Central Government department which is situated at Noida can claim entitlement either for the allotment of accommodation in Delhi or for retaining the same. In the office memorandum of the Government dated 15.9.1999 the Government made the position very clear that the Department of Lighthouses and Lightships will not be considered as an eligible office for further allotment of general pool accommodation in Delhi w.e.f. 12.8.98. The contention of counsel for the petitioner that the said office memorandum only restricted further allotment and did not deal with the accommodation already in occupation of the employees also lacks force. The names of the employees of the Department were given in the said office memorandum itself and, therefore, the petitioner cannot be heard to complain that the said office memorandum was not applicable to the employees who are already occupying the Government accommodation.

In the light of the above position, this Court does not find any infirmity or illegality in the order passed by the learned Estate Officer and the order dated 1.9.2001 passed by the learned Appellate Court. The present petition is a gross abuse of the process of the Court as the petitioner had earlier invoked the jurisdiction of the Central Administrative Tribunal so as to challenge the order of cancellation dated 4.11.99 and the order of the Central Administrative Tribunal attained finality after the Division Bench had dismissed the writ petition filed by the petitioner vide orders dated 28.2.2001. The proceedings under the Public Premises Act were not yet initiated by the Estate Officer and, therefore, the jurisdiction of the Central Administrative Tribunal cannot be in dispute so far the challenge to the cancellation order was concerned. Even otherwise, the petitioner himself had invoked the jurisdiction of the Central Administrative Tribunal and that of the writ court and, therefore, cannot claim that he had wrongly invoked the jurisdiction of both the Courts. The judgments relied upon by the counsel for the petitioner will be of no help in the facts of the present case.

9. In the light of the foregoing, there is no merit in the present petition and the same is hereby dismissed.
