Facts:-

Shri Sunil Kumar Gupta, vide his RTI application dated 06/02/2009, sought information from Branch Manager, Oriental Insurance Company, Jwalapur, Hardwar, through 02 points pertaining to his insurance policy taken through the Punjab & Sindh Bank, Hardwar. Information sought pertained to number of premiums paid and policy No. and whether the Insurance Company have provided the insurance policy to the bank.

2. Failing to receive reply from the CPIO, the appellant preferred complaint before the Commission.

3. The matter was heard today through video conferencing. Both parties were present as above. Respondent stated that they were unable to provide information to the complainant since he had not provided the Year in which he had been insured along with the period of insurance cover.

4. Complainant responded that he had attached copy of Bank's letter dated 20/10/2008 for their reference in which the year in which the policy was taken was provided.

DECISION

5. Respondent could not provide any reason for not having responded to the RTI application and acknowledged having received the same in their Jwalapur, Haridwar Office which is headed by Senior Divisional Manager and confirmed that the Senior Divisional Manager of the Divisional Office, Haridwar was the holder of the information sought by the appellant. Treating the Senior Divisional Manager, Divisional Office, Oriental Insurance Company, Hardwar as deemed CPIO and holder of information, and after having heard him in person today as prescribed u/s 20(1) of the Act, the Commission awards a maximum penalty of Rs. 25,000/- to the officer since the delay by him is by 18 months.

The Chief Regional Manager, Oriental Insurance Company, Dehradun is directed to recover the amount of Rs. 25,000/- from the salary of the Senior Divisional Manager, Divisional Office, Oriental Fire & General Insurance Company, Haridwar and remit the same by a demand draft or a Banker's Cheque in the name of the Pay & Accounts Officer, CAT, payable at New Delhi and send the same to Shri Pankaj K.P. Shreyaskar, Joint Registrar and Deputy Secretary of the Central Information Commission, 2nd Floor, August Kranti Bhawan, New Delhi-110066.

7. The amount may be deducted at the rate of Rs.5000/- per month every month from the salary of the Senior Divisional Manager, Divisional Office, Oriental Insurance Company, Dehradun and remitted by the 10th of every month starting from September, 2010. The total amount of Rs.25,000/- will be remitted by 10th of January, 2011.

8. Complainant is directed to provide details of the policy as sought by the respondents to them within one week of receipt of this order.

9. Respondents are directed to provide full and complete information to the complainant within 03 weeks thereafter.
