Heard learned counsel appearing on behalf of the petitioners and learned Additional Public Prosecutor appearing on behalf of the State.

Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today.

The accused/petitioners are named in the F.I.R. and apprehending their arrest in connection with Mehus P.S. Case No. 60 of 2022 registered for the offences punishable under Sections 147, 149, 341, 323, 448, 354(B), 504, 506 of the Indian Penal Code.

The allegation against above named petitioners is to assault informant and others including family members by Patna High Court CR. MISC. No.68815 of 2022(2) dt.29-04-2023 2/3 means of fists and slaps, causing bodily injuries and also alleged thereof to outrage modesty of daughter-in-law of the informant.

It is submitted by learned counsel appearing on behalf of the petitioners that from bare perusal of the FIR, it appears that the petitioners were in inimical terms with informant as he informed police regarding involvement of petitioners in illegal activities of illicit liquor. It is also submitted that in fact informant and his family members assaulted petitioners and their family members and for the said occurrence a complaint case bearing no. 296 C of 2022 dated 24.08.2022 was filed before the learned C.J.M., Sheikhpura. It is also pointed out that allegation against these petitioners are appearing very much general and omnibus and without attributing any specific overt act. While concluding the argument, it is submitted that petitioners are of clean antecedents.

Learned APP, opposes the prayer of bail.

Considering the aforesaid facts and circumstances and by taking note of nature of allegation which is without attributing specific overt act, let above named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) Patna High Court CR. MISC. No.68815 of 2022(2) dt.29-04-2023 3/3 each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Sheikhpura/concerned Court, where the case is pending in connection with Mehus P.S. Case No. 60 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
