26. itis noticed that since the merger of the cadres of Sf Gril and Si Gr. H has been effected fram 1.1.2006, on the date the DPC held on 5.9.2014 or an 26.6.2015, both the cadres had merged from 1.1.2006 and hence, there was no existence of the cadre of Si Gr. if separately an 416.2.2011 even to allow notional promotion. Hence, the applicant's averment that the number of posts in the merged cadre was 42 fout of which 34 posts were from the cadre of 3! Grail and 8 from the cadre of S! Gr. it}, canmmat Be brushed aside. The promotion quota for the combined cadre was 50°8 of 42 posts ie. 21 posts, out oy which I2 persans were in position as on 16.2.2011 leaving 9 vacancies. Hence, the DPC held on 5.9.2014 should have selected the candidates for promotion to the combined post of SI Gril/ul for 9 pasts vacant in the combined cadre. The contention of the respondents that there was no provision in the Recruitment Rules for promotion to the combined post of $) GrJdI/ill is not tenable, since the rules as on 16.2.2011 provided for promotion to 3! Gri, which has to be taken as the provision for Si Gril after merger of S! Gr.Hl and St Gril ti! the notification for new rules wef. 27.11.2013 vide Annexure-R/9 of the Caunter. In absence of any policy guidelines that ll notification of the revised Recruitment Rules after merger of the cadres of 81 Gr and SI Grill there will nat be any promation of the employees to the oe ost of SY Galil under the extant niles. we are of the x considered view Shot for sromotion fo 9} Grn dil/Gr il nationally wef, 16.2.2011, the vucencies of 9 posts in the combined coders is to be considered and OPC is to be convened as per the Resruitmrent Rules which were in force. The only way to consider promation of the eligible employees to the post of 3! Hence, we are unghie to accept the contention af the respondents that as an 16.2.2011, there were only 5 vacant posts, since the pasts in the cadre of Si Grif were not taken inte consideration.
i¥. From the pleadings of the respondents. it is clear that such g situation has arisen entirely due to fault of the authorities. Firstly, the DPC and review DPC were held an 33.2014 and 26.68.2018 respectively, without first ascertaining the vacancies available in the cadre. Secondly, the mistake in the assessment of vacancy could not be identified by the respandents within a reasonable time ofter the auplicant was alowed ad hac promotion wef 13.10.2010 and regular promotion we. £ 5.9.2014 with notional seniority from 16.2.2011 and the mistake was identified after a fapse af about three years fh! 18.10.2017 {A/?) when the show cause notice was issued ta the applicant. There is no whisper in the pleadings of the respondents about the reasons for such mistake on the part of the authorities and for delay in identifying the said mistake. Thirdly, the reasons mentioned in the respondents' pleadings for not considering the vacancies in the codre of Sf Gro if befere deciding the case of reversion of the applicant, are not acceptable as discussed in para 16 of this order.

PGr tH weet, 36.2.2032 ty convening a review OPC after taking into for the pasts of t the 5 Mf Gru and Sf Ged as discussed in seragraph 16 of this order and if the applicant is recommended by the DPC for notional promotion wef. 28.28.2013, then the respondents will allow aif consequential benefits as per the letter dated 26.8,2014 iAnnexure-A/3) of the 11 respondent No.2. in case the applicant cannot be promoted w.e.f. 16.2.2011 in view of the available vacancies in the combined cadre as on £6.2.2011, then his case for notional promation will be considered on or after 17.2.2011 as and when vacancies of SI Grul/Grifl are available as per the rules prevalent during the aforesaid period. if the apalicant will be found eligible for national promotion te the combined cadre of AiGr Hoand Geil from an earlier date, then he will be assigned the seniority from the date/year he would be found suitable for such promation as per the available vacancy and he would be allowed ail consequential service benefits for such national pramotion as per the rules, The respondent No.2 will communicate the decision taken in this regard to the applicant through a speaking order within four months from the date of receipt of a capy of this order based an the recommendation of the review DPC to be convened as per this order. The OA No. 170/18 is eccordingly allowed in part as above, itis seen from the said order that this Tribunal had held that it was fankt/errar of the respondents (1 not calculatin @ the vacancies OAT groperiy thar resulted In the order af reversion. The said promotion was made retrospective wel, 19.02.2006 vide order dated IS10.2020, The stand of the respondents that since ne posts were available hence ng pay can be granted to the applicant canner be sustained in view of decision of Hon'ble Apex Court in the case of Smit. P. Grover vrs State of Haryana & Ors 198s ATR 1060 wherein it was heir:

Grover is entitled to be paid the salary of a District Education officer fram the date she was promoted to the vost, that is, July 19, 1976, until she retired from service on August 31, 1980. The appeal is accordingly allowed with rasts."
