Sai Deepak, learned counsel for the appellant in FAO(OS)(COMM) No.38/2023 states that he would file a revised packaging retaining the registered word mark 'FABIO' on the basis of which the present appeal may be decided without prejudice to the rights and contentions of the appellant at trial.
