JUDGMENT
1. Vide this judgment, the present petition filed by petitioner Sh. Rahil Taneja for extension of succession certificate (granted in favour of the petitioner vide judgment / order dated 07.06.2019 and 09.07.2019) in his favour qua the debt and securities in the name of Late Sh. Om Prakash Taneja, with the bank/company concerned in the form of balance credits, shall be disposed of.
2. In the petition, it is inter-alia pleaded that Late Sh. Om Prakash Taneja, who passed away intestate on 22.07.2017, was the father of the petitioner and respondent no. 2 & 3. It has been averred to the present application that after grant of above mentioned succession certificate, the petitioner got to know about certain other share certificates of various companies of his deceased father Late Sh. Om Prakash Taneja. Hence, the present Succ No. 198/23 Page No. 2 of 39 petition has been filed for extension of succession certificate with respect to the aforesaid left out share certificate as the same were not in the knowledge of the petitioner at the time of applying and grant of previous succession certificates.
3. During the summary proceedings conducted as per Section 376 of the Indian Succession Act, 1925, four witnesses were examined.
4. Sh. Ashok Kumar, SPA holder for petitioner was examined as PW-1 and he tendered his evidence by way of affidavit Ex. PW- 1/A and he relied upon documents which are as follows :
(i) Ex.PW1/1 (original SPA dated 13.03.2023);
(ii) Mark PW1/2 (self attested copy of passport of petitioner);
(iii) Ex.PW1/3 (OSR) (copy of Aadhar card of SPA holder);
(iv) Ex.PW1/4 (death certificate of deceased Late Sh. Om Prakash Taneja);
(v) Mark X (photocopy of death certificate of Late Ms. Zohra Ali Shah);
(vi) Ex.PW1/5 (copy of Surviving Member Certificate);
(vii) Ex.PW1/6 (colly) (copy of order dated 07.06.2019 & 09.07.2019);
(viii) Ex.PW1/7 to Ex.PW1/33 (OSR) (share certificate of companies;
(ix) Mark Y1 (copy of letter of Indian Metal & Ferro Alloys Ltd.);
(x) Mark Y2 (copy of letter dated 04.03.2021 of RACL Tech Ltd.);

(xv) Ex.PW1/37 (certificate u/s 65B IEA); (xvi) Ex.PW1/38 (colly) (original NOC of respondent no. 2 along with signed copy of Aadhar card of respondent no.2 and copy of Surviving Member Certificate);
(xvii) Ex.PW1/39 (colly) (original NOC of respondent no. 3 along with signed copy of passport of respondent no.3 and copy of Surviving Member Certificate).
5. The Surviving Member Certificate i.e., Ex. PW-1/5 reflects the petitioner and the respondents namely, Sh. Nikhil Taneja and Ms. Shalini Taneja as the Class-I legal heirs of the deceased Late Sh. Om Prakash Taneja.
6. Further, PW-2 Sh. Jagdish Mandal, Data Entry Operator, Skyline Financial Services, Okhla Industrial Area, Phase I, New Delhi, brought the details pertaining to shares of M/s Sukhjit Starch & Chemicals Ltd. bearing Folio no. 8323 in the name of Late Sh. Om Prakash Taneja and deposed the details as under :-

7. PW-3 Sh. Sharwan Mangla, General Manager, Compliance Officer, MAS Services, Okhla Industrial Area, Phase II, brought the details pertaining to equity shares of RACL Geartech Ltd. bearing Folio no. 0003083 in the name of Late Sh. Om Prakash Taneja and the details of the same are as under :

8. RW-2 Sh. Sanjeev Makkar, SPA Holder for respondent no.
2 & 3 deposed that respondent no. 2 Sh. Nikhill Taneja and Ms. Shalini Taneja have no objection if succession certificate is issued in the favour of petitioner. No objection certificate given by way of affidavit on behalf of the aforesaid respondents is Ex.RW2/A and Ex.RW3/A. Copy of Special Power of Attorney on behalf of Succ No. 198/23 Page No. 6 of 39 respondent no.2 & 3 are Ex.RW2/1 (OSR) and Ex.RW3/1 (OSR) respectively. Copy of Aadhar card of respondent no. 2 is Ex.RW2/2 (OSR).
9. The entire record as well as the testimonies of the witnesses have been perused.
10. Perusal of Ex. PW-1/5 (Copy of surviving member certificate) shows that Sh. Rahil Taneja (petitioner, son), Sh. Nikhill Taneja (respondent no. 2, Son) and Ms. Shalini Taneja (respondent no. 3, daughter) are the only legal heirs of Late Sh. Om Prakash Taneja. Further, no one came forward to oppose issuance of succession certificate despite publication in newspaper.
11. In view of the Surviving Member Certificate and NOC given by respondent no. 2 & 3, it is hereby ordered that succession certificate be issued in favour of Sh. Rahil Taneja for the debts and securities of Late Sh. Om Prakash Taneja, which are as follows:

As per valuation report furnished on behalf of the petitioner, online Market Value of above-mentioned Shares of Twenty Eight (28) Companies (as on 16.09.2024) is Rs.19,74,757.28/- (Rupees Nineteen Lakh Seventy Four Thousand Seven Hundred Fifty Seven and Paise Twenty Eight Only). (Serial No.14 has been dropped as the Respondent No.2 has already claimed the said shares).
12. The succession certificate shall be considered only as an entitlement of the petitioner to receive the amount (with applicable interest till date, if any) due towards Late Sh. Om Prakash Taneja as referred above. The succession certificate Succ No. 198/23 Page No. 38 of 39 shall not be considered as a direction to concerned bank/official to transfer the aforesaid amount to petitioner. The concerned bank/official shall be competent to seek compliance of formalities, if any, to be fulfilled for the said purpose.
13. Upon filing of requisite Court fees of Rs. 39,495.1456/-
and indemnity bond by petitioner, succession certificate be issued.
14. File be consigned to Record Room after due compliance as per law.
