Date : --13.08.2025 Heard Mr. S. Borthakur, learned counsel for the petitioner and Ms. M. Kumari, learned Standing Counsel, CBI for the respondent CBI.

2. The instant criminal petition is preferred assailing an Order dated 18.07.2025, passed by the Court of learned Special Judge, CBI, Assam in connection with RC no. 17[E]/2024/CBI/New Delhi, whereby, the petitioner's prayer for interim custody of the items Page No.# 2/2 mentioned therein has been rejected.

3. Issue notice, returnable on 10.09.2025.

4. As Ms. Kumari, learned Standing Counsel, CBI has appeared and accepted notice for the respondent CBI, formal notice need not be issued to the said respondent. Mr. Borthakur, learned counsel for the petitioner shall furnish an extra copy of the criminal petition along with the annexures, to Ms. Kumari within 2 [two] working days from today.

5. As Ms. Kumari, learned Standing Counsel, CBI has sought and is granted 3 [three] weeks' time to file its reply as regards the claim for custody made by the petitioner in respect of the items. It is submitted by Ms. Kumari that some of the items involved therein might have been sent for retrieval of data. If the items are so sent, the present status of the retrieval process shall also be mentioned in its reply.

6. List the case accordingly, on 10.09.2025.
