% 08.08.2022 This is a petition seeking direction to the respondent to conduct fair and speedy investigation in FIR No. 0021/2018 dated 03.02.2018 u/s 420/406/120B IPC at P.S. I.P. Estate.

As per the petitioner, the petitioner, son and daughter in law invested in a residential project, namely 'Sunworld Arista' located at Sector 168 Noida Expressway, Noida, UP. The petitioner's son and daughter-in-law opted for 1 apartment, namely 304, Floor 3 Tower name/block T-I, Super Area 2100 sq. ft. and entered into an agreement with the builder and ICICI Bank.

The price of the flat 1,28,40,000/-, out of which the petitioner's son and daughter-in-law paid a sum of Rs. 13,83,143/- and the balance amount Signature Not Verified Digitally Signed byAMIT ARORA Signing Date:18.08.2022 10:22:46 was paid by ICICI Bank.

The petitioner's son and daughter-in-law exercised their option to cancel the booking prior to completion of 24 months and sought refund of their money. Since no amount was paid, the FIR No. 0021/2018 was registered on 03.02.2018. A period of 4 and a half years has expired and the investigation is still under progress. This is not an acceptable state of affairs. The DCP shall personally look into the same, file a detailed status report indicating action taken, delay in action not taken within 2 week from today and in case it is not done, he/she shall be personally present in Court on the next date of hearing.
