1. The hearing has been conducted through video conferencing.

2. By this application, petitioner seeks interim bail on the ground of his treatment. On the last date of hearing, this Court had called for the latest medical report of the petitioner from Jail.

3. As per the report received the petitioner is suffering from bleeding per rectum since September, 2016. Petitioner has also undergone surgery of umbilical hernia in the year 2017 as is evident from the previous record and was granted interim bail number of times on this count. Petitioner is also suffering from diabetes mellitus Type-II and is on regular treatment thereof.

As per the medical report received pursuant to the complaint dated 30th January, 2020 the petitioner was referred to DDU hospital where his ultrasound abdomen was conducted on 5th February, 2020 which was also suggestive of umbilical hernia. In the last review on 8th May, 2020 by the jail doctor the petitioner was diagnosed as a case of grade-II Hemorrhoids and umbilical hernia and is on symptomatic treatment. Further despite symptomatic treatment, the symptoms of the petitioner are persistent.

A perusal of the nominal roll of the petitioner reveals that the petitioner has been granted interim bail number of times and as per the nominal roll there is no allegation that the petitioner misused the said concession. Though the allegations against the petitioner are serious in nature as he is involved in a conspiracy for supplying narcotic drugs and is facing trial under Sections 18/21/22/29 of NDPS Act, however, considering the present medical condition of the petitioner and that in view of the symptoms with regard to umbilical hernia still persisting despite previous surgery and symptomatic treatment, this Court deems it fit to grant interim bail to the petitioner.

It is, therefore, directed that the petitioner be released on interim bail for a period of eight weeks from the date of his release on his furnishing a personal bond in the sum of ₹1 lakh with one surety bond of the amount of ₹10 lakhs to be furnished by a family member of the petitioner to the satisfaction of the Court Concerned/Duty Magistrate.

7. Learned counsel for the petitioner submits that the documents furnished by the surety are already on Trial Court record.

8. Application is disposed of.
