2. it is submitted on behalf of the applicant that the applicant is qualified for the past of Track Maintainer Grade-l| under the respondents. He is senior most among the candidates who are eligible for promotion. {t is brought to the notice of the Tribunal that as per the guidelines for promotion, equal number to that of vacancies are to be called for viva-voce, but on the contrary, the Re Amys. io aera sag ¥;

The applicant submitted representations dated 03.11.2018, 08.12.2018 and 05.03.2019 to the department expressing his grievance to consider his case for pramation to the post of Track Maintainer Grade-] as per the fFocedure prescribed. The said representations are pending with the respondents without any action.
4. Having regard to the facts and circumstances of the case, we are inclined to dispose of the OA without going inte the merits of | the case.

5. Respondents No.l is directed to consider the representations and also the OA as ane of the representations and dispose of the same by passing appropriate orders within a period of eight weeks.
