ORAL ORDER
03. 23.06.2014Considering that the Petitioners are ready to refund a sum of Rs. 1,00,000/- (One Lakh).
Issue notice to Opposite Party No. 2, for which requisites etc. under registered cover with A/D as well as ordinary process must be filed within 10 days, failing which this application shall stand rejected without further reference to a Bench.
Notice through ordinary process shall go to the concerned Court to be served upon the Counsel appearing on behalf of the Opposite Party.
Rule is made returnable within six weeks. In the meanwhile, let the Petitioners, above named be released on provisional anticipatory bail till further orders in the event of arrest or surrender before the learned Court below within a period of four weeks from the date of receipt of the order on furnishing bail bond of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each or any other surety as fixed by the Patna High Court Cr.Misc. No.17802 of 2014 (3) dt.23-06-2014 2 Court to the satisfaction of Chief Judicial Magistrate, Patna in connection with Complaint Case No. 1732(C) of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also subject to the conditions that one of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the Petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioners.
