श्री राम विलास पासवान (हाजीपुर) :अध्यक्ष महोदय, मैं एक ऐसे महत्वपूर्ण विषय की ओर आपका ध्यान आकर्षित करना चाहता हूं जिस के प्रति दोनों पक्षों के लोग एक हैं और वह डीलमिटेशन कमीशन का मामला है। डलमिटेशन एक्ट २००२, के मुताबिक डीलमिटेशन कमेटी का गठन हो गया। उसमें आपने एज ए स्पीकर प्रत्येक राज्य से अधिक से अधिक पांच मैम्बर्स को नियुक्त किया है। उसमें १० एसोसिएटिड मैम्बर्स होते हैं जिन में से पांच लोक सभा और पांच असेम्बली के होते हैं। इनको नॉमिनेट किया जा चुका है बहुत दिन हो गए हैं लेकिन आज तक उस डीलमिटेशन कमेटी का ऑफिस कहां है, वह कहां काम कर रहा है, क्या हो रहा है, किसी मैम्बर ऑफ पार्लियामैंट को पता नहीं है। डीलमिटेशन एक्ट के मुताबिक यह लिखा हैThe Commission shall associate with itself for the purpose of assisting it in its duties in respect of each State.
सभी मैम्बर्स का काम एसोसिएट करना और उनको असिस्ट करना है लेकिन किसी मैम्बर को इसका पता नहीं है। इसलिए यह आपका मामला है, हम लोगों का मामला नहीं है। या तो सब को हटा दीजिए। बनी बनायी चीज आए और उसके बाद हम सब को मोहर लगाने के लिए कहा जाए, मैं समझता हूं कि यह प्रिवलेज का मामला है। मैं आग्रह करना चाहता हूं कि एसोसिएटिड मैम्बर्स की एक्ट में कहीं डैफिनेशन नहीं है लेकिन यह डयूटी मानी जाती है कि वोटिंग राइट्स के अलावा मैम्बर्स के सब अधिकार उनके पास मौजूद हैं।
लेकिन मैं दोनों पक्षी की तरफ से कहता हूं कि किसी भी मैम्बर को इस बात की जानकारी नहीं है। इसलिये मैं आपसे रूलिंग चाहता हूं कि आप एसोस्एटेड मैम्बर्स को प्रोटैक्ट करने का काम कीजिये।

SHRI PRIYA RANJAN DASMUNSI : The very Act of Delimitation which was passed by this House did indicate firstly that the year 1991 should be the basis. Section 5 of the Act that we have passed provides for the role of the Associate Members. I had the privilege to serve the Delimitation Commission in 1971 when I was in this House. At that time the procedure was that the State Electoral Office shall prepare a draft document consulting the Associate Members and the Members and that draft should come to the main Commission. The commission will go on hearing that draft involving the sitting MPs of that particular House to know their observations.
Unfortunately now the basic departure is that the State Electoral Office has not been asked to prepare any draft; Members also have not been asked to give any proposals; a suo motu draft has been prepared from the Central Delimitation Council and suddenly the Members are called and told that this is the draft and this is the summary. In 99 per cent of cases the fate of the Members and their constituencies are decided in a suo motu manner.
Secondly, no specific guideline has been formulated pertaining to the role of the Associate Members in the Delimitation Commission as to how they will proceed on the issue. Thirdly, - and this is most important – the Delimitation Act complements to only readjustment of the boundaries of Assembly and Lok Sabha constituencies whereas in this case the entire reorganisation of the constituency is being done. Therefore, a lot of apprehension has been created. I desire that the hon. Law Minister should first consult the present Members who are in the capacity of Associate Members to know the details without wasting the time of the House and come back to the House with the comprehensive guidelines, and if necessary with necessary amendment to the main Act also.
I think that can solve the problem to a great extent. Otherwise, I am afraid, we are all under suspicion and doubt as to what is being done to our constituencies and nobody is taken into confidence.
श्री मदन लाल खुराना (दिल्ली सदर): अध्यक्ष महोदय, जो दोनों माननीय सदस्यों ने बात कही है, मैं इससे सहमत हूं क्योंकि दिल्ली के साथ भी यही हुआ है। इंट्रेस्िंटग बात यह है कि ड्राफ्ट पहले आया कि डी-लीमिटेशन कमीशन की तरफ से दिया जा रहा है लेकिन अगली मीटिंग में आया कि तीन सदस्यों में से एक सदस्य की ओर से दिया जा रहा है जबकि मैम्बर्स को पता नहीं है। हम से कहते हैं कि इस बारे में बात करिये लेकिन अपनी बात मत करिये। इसके पहले भी कमीशन बने हैं, हम हाजिर हुये हैं लेकिन जिस तरह से यह कमीशन काम कर रहा है, उससे मुझे लगता है कि…( व्यवधान)यहां बी.जे.पी. की बात नहीं, दिल्ली में तो कांग्रेस है। मैं कह रहा था कि मनोवृत्ति यह है कि जो हमने बना दिया, वह फाइनल होगा। क्या किसी मैम्बर की कोई वेल्यू नहीं है? मेरा कहना है कि इस मामले पर पुनर्विचार करना चाहिये।
अध्यक्ष जी, एक छोटी सी बात यह कहना चाहता हूं कि इस डी-लमिटेशन कमीशन का आधार १९९१ बनाया गया है जबकि यह २००१ होना चाहिये था। दिल्ली की आबादी १९९१ में ९४ लाख थी जो आज बढ़कर डेढ़ करोड़ हो गई है। इसलिय् मेरा कहना है कि इस कमीशन का आधार २००१ होना चाहिये था। जो प्रक्रिया है, उसके अंदर पुनर्विचार करना चाहिये। ऐसा नहीं होना चाहिये कि कमीशन ने हम पर थोप दिया? सरकार इसे करेगी या नहीं?...( व्यवधान)
13.00 hrs. डॉ. रघुवंश प्रसाद सिंह (वैशाली): अध्यक्ष महोदय, इसी सदन से डीलमिटेशन आयोग का गठन हुआ और कानून के तहत आपने हम लोगों का नाम उसमें चयन किया कि डीलमिटेशन आयोग में हम लोग एसोसिएट रहेंगे। लेकिन डीलमिटेशन कमीशन की कहीं कोई बैठक नहीं होती है और न कोई राय-मशविरा लिया जाता है। जिस बात के लिए इस कमीशन का गठन हुआ, वह काम नहीं कर रहा है। इसलिए सरकार डीलमिटेशन कमीशन को भंग करे या हम लोगों का नाम उसमें से हटवा दिया जाए। जो सरकार को उचित लगे वह सरकार करे। हम लोगों से कुछ पूछा नहीं जाता है, कोई राय-मशविरा नहीं किया जाता है। उसका डी.डी. एडजस्टमैन्ट करना है, क्षेत्र को इधर-उधर करना है, लेकिन हम लोगों को कोई जानकारी नहीं है। यह कौन कर रहा है, इसके लिए सरकार कसूरवार है, वह ऐसी हेरा-फेरी से काम करवा रही है। सरकार या तो इसे भंग करे या हम लोगों का नाम इसमें से काट दे। हम लोग इसमें रहना नहीं चाहते हैं।

श्री विजय कुमार खंडेलवाल: अध्यक्ष जी, मध्य प्रदेश में डीलमिटेशन एक्ट बनने के बाद वहां से इंफॉर्मेशन लीक की जा रही है और यह कहा जा रहा है कि हम इसी तरह से काम करेंगे। पेपर्स में रोज छपता है कि डीलमिटेशन कमीशन के द्वारा ये रिपोट्र्स आई हैं या तो जो पेपर्स की रिपोट्र्स हैं, उनके खिलाफ एक्शन हो, यदि डीलमिटेशन कमीशन ने ये रिपोट्र्स मध्य प्रदेश में दी हैं। खुराना जी ने जो किया है, उसको हम सपोर्ट करते हैं।

The issue is concerning the Law Minister. I want to know whether the Government would like to make any observation on this issue.
On the issue of delimitation, it seems that the whole House is very sensitive. They want this issue to be considered and want to express their opinions. Some Members have already expressed themselves. Now, I cannot allow every Member to speak on this issue. Would the Government like to say something on this issue?
