THE COURT MADE THE FOLLOWING:-
ORDER
In this petition, petitioner seeks review of the impugned order passed by this Court in W.P.No.18832/2022 dated 22.09.2022. The operative portion of the impugned order reads as under:
"(i) The petition is hereby allowed and disposed of in terms of the following decisions rendered by this Court:-35
(i) Ms. Nireeksha.s v/s Rajiv Gandhi University of Medical Sciences - WP No.10244/2021 and connected matters dated 01.07.2021.
(ii) Rahul V.Reddy v/s Rajiv Gandhi University of Medical Sciences - WP No.8692/2022 dated 21.04.2022.
(iii) Dhisha Vivek v/s Rajiv Gandhi University of Medical Sciences - WP No.7999/2022 dated 19.04.2022.
(iv) Sanjna Hedni v/s Rajiv Gandhi University of Medical Sciences - WP No.9285/2022 dated 05.05.2022.
(ii) Respondent No.1-University is directed to conduct two additional valuations in respect of the subjects, in which the petitioners have been declared to be unsuccessful in MBBS (RS3) Examination held in July/August 2022.
(iii) After conducting two additional evaluations as directed supra, respondent No.1-
University is also directed to declare the fresh results of the petitioners by taking into account and computing the average of *two highest marks awarded among all the valuators as expeditiously as possible.
(iv) The respondent No.1 shall complete the entire exercise and comply with the aforesaid directions within a period of six weeks from the date of receipt of copy of this order."
2. Heard learned counsel for the petitioner and learned counsel for the respondent Nos.1 to 147 and perused the material on record. In view of the order 36 proposed, no notice is issued to respondent No.148 - National Medical Commission.
3. Learned counsel for the petitioner on instructions submits that the petitioner is not aggrieved by the direction Nos.(i), (ii) and (iv) contained in the operative portion of the impugned order. The challenge in the present review is restricted to direction No.(iii) issued by this Court whereby the petitioner - University was directed to declare the fresh results of the writ petitioners by taking into account and computing the average of two highest marks awarded among all the valuators as expeditiously as possible. It is contended that the direction to declare fresh results by computing the average of 2 highest marks is an error apparent on the face of the record and instead the average of 4 highest marks is to be taken.
4. In support of his contentions, learned counsel for the petitioner places reliance upon the decision of the Co-ordinate Bench of this Court in Basanth K.B., Vs. Rajiv Gandhi University of Health Sciences and another - 37 W.P.No.231/2021 and Connected matters (D.D.11.02.2021).

It is contended that there are no regulations governing the undergraduate course of the RGUHS insofar as the methodology of declaring the result by computing / taking average of either two highest marks or four highest marks. However, in the aforesaid judgment, this Court has held that in the absence of any regulation governing methodology of declaring results after additional evaluation, the Ordinance dated 29.03.2019 governing the Post- graduate course has to be considered, in particular clause 4(a) which contemplates taking of average of total marks awarded for the four valuations. It is therefore submitted that direction No.(iii) issued by this Court in the operative portion of the impugned order directing the review petitioner
- University to declare the results by taking into account and computing the average of two highest marks is contrary to the aforesaid judgment of this Court and is error apparent on the face of the record and warrants review by this Court.

6. Per contra, learned counsel for the respondents - writ petitioners would support the impugned order and submits that there is no merit in the petition and that the same is liable to be dismissed.

He invites my attention to the judgment of the Co-ordinate Bench of this Court in Basanth K.B.'s case supra, in order to point out that in the said case, four valuations pertaining to the students / petitioners therein had already been done and this Court while quashing the Ordinance dated 13.10.2020 directed the RGUHS to refer the same to a fifth valuation and it is only in the context of fifth valuation that this Court directed the respondent - University to apply the formula of taking the average of 4 valuation as contemplated in the aforesaid Ordinance. It is further contended that the said judgment rendered by this Court is not applicable to the facts of the instant case where this Court directed valuation to be done by two additional valuators in addition to the two valuations that had already been done and consequently, there is no error 39 apparent on the face of the record warranting review by this Court in the present.
8. Learned counsel for the respondents places reliance upon the judgment of the Co-ordinate Bench of this Court in Kumari Renuka Vs. The Karnataka Pre- University Board - ILR 1997 KAR 3179 in order to point out that in the absence of regulations or ordinance, it is necessary to lean in favour of the students, in view of the fact that the provisions for revaluation are meant for the benefit of the student community. It is therefore contended that there in no merit in the petition and the same is liable to be dismissed.
9. I have given my anxious consideration to the rival submissions and perused the material on record.
10. In Basanth K.B., Vs. Rajiv Gandhi University of Health Sciences and another - W.P.No.231/2021 and Connected matters (D.D.11.02.2021), this Court quashed the Amendment of Ordinance governing valuation of answer scripts of MBBS 40 Course (RS - 3 Scheme) notified on 13.10.2020 and issued further directions. The operative portion of this Court order in the said judgment reads as under:
"ORDER
1. The writ petitions are allowed.
2. The "Amendment to Ordinance Governing Valuation of Answer Scripts of MBBS Course (RS-3 Scheme)" notified on 13.10.2020, is hereby quashed and set aside.
3. The respondent - RGUHS is hereby directed to apply the formula as provided in the Ordinance governing the PG students of the respondent - University, identify all the cases where there is a difference of 15% or more in the four valuations and send them for fifth valuation. The exercise shall be restricted to failed students only.
4. Declare the results applying the provisions governing PG students of the respondent - University, after the fifth valuation and proceed to issue marks card accordingly.
5. The entire exercise shall be completed well before the commencement of the next year examinations which is tentatively scheduled to commence during first week of March 2021."
As is clear from the operative portion of the said judgment, this Court took note of the fact that four 41 valuations had already been done and additional 5th valuation and declaration of the results were directed to be done in accordance with the ordinance governing the PG students dated 29.03.2019, which provided for computing and taking the average of 4 highest marks and not 2 highest marks.

However, in the instant case, it is undisputed fact that insofar as the respondents - writ petitioners are concerned, only two valuations had been done and not four valuations as in Basanth K.B.'s case supra before this Court and consequently, this Court directed two additional valuations to be done in addition to two valuations that had already been done. In view of this crucial / vital distinction in both the cases, I am of the considered opinion that the directions issued to RGUHS to conduct an additional 5th valuation and declare the results by applying the formula in terms of the PG Ordinance dated 29.03.2019 as held in Basanth K.B.'s case cannot be made applicable to the present respondents in relation to the direction to do 2 (two) valuations in addition to 2 (two) valuations already done. 42 Under these circumstances, having regard to the special / peculiar facts and circumstances of the instant case, the judgment of the Co-ordinate Bench of this Court in Basanth K.B.'s case is not applicable and non-consideration of the said judgment of this Court while passing the impugned order cannot be construed as error apparent on the face of the record. It is needless to state that in Jordan Pidhya Rasquinha and others Vs. Rajiv Gandhi University of Health Science - W.P.No.13312/2022 & connected matter (D.D.27.07.2022) relied upon by the review petitioner, this Court has merely noticed the earlier judgment of this Court in Basanth K.B.'s case and consequently, even the said judgment in Jordan's case cannot be relied upon by the review petitioner in support of its contentions.

The material on record also discloses that there are no regulations / ordinances governing the formula to be applied for the purpose of declaring the results in relation to the undergraduate students of the RGUHS. In this context, as rightly contended by the learned counsel for 43 the respondents, in Kumari Renuka's case supra, this Court at para Nos.12 to 16, it is held as under:
"12. In the absence of an express provision as to what should happen when a certain state of things exist, it is not permissible to adopt one among several solutions, which is detrimental to the interests of the students, when other beneficial alternatives exist. As already held, the principle relied on by the Department, that it is permissible to supply words which appear to have been accidentally omitted, will apply only where the word or words to be added are the only word or words that can be added and there is an obvious omission thereof. That principle will not apply where different sets of words with different meanings can be added. To illustrate: If a section provides that a particular act is an offence and the offender shall be punished, but fails to prescribe the quantum or type of punishment, obviously it cannot be contended that the offender should be imposed the maximum punishment of life imprisonment.
13. In view of above, it is not possible to accept the contention of the department that the words by incorporating the marks obtained in revaluation should be added to the end of the Sub-rule (4) of Rule
29. Consequently, the contention of the Department that revaluation marks shall be substituted for the original marks, is rejected.44
14. In the absence of a logical meaning to the last portion of Rule 29(4), it is more appropriate to construe it in a manner, which is beneficial to the student. As pointed out above, a student applies for revaluation only when he is not satisfied with the result and feels that he got lesser than what his performance deserved. If a student feels that he has obtained more marks than expected, he will not apply for revaluation. In fact, sub-rule (1) of Rule 29 provides for revaluation of answer scripts of the "students who are not satisfied with the valuation already done". Hence, the provision for revaluation, is a beneficial provision intended for the benefit of the student community and should therefore be interpreted in favour of the students, if there is ambiguity. Of course, where the provision is clear, the question of interpretation in a manner beneficial to the student, contrary to the specific provision, will not arise.
15. Rule 29(4) merely says that if the variation is six or more, a fresh marks card should be issued. But what should be the marks to be shown in the fresh marks card is not stated. In such circumstances the benefit of interpretation should be given to the student and it should be interpreted as giving the revaluation marks, where there is an upward increase of six or more marks and retention of the original marks if there is a downward revision. Of course, the State Government can set right the defect in Rule 29(4) by incorporating suitable words to give effect to 45 what it intended to happen if there is a variation of more than five. But, until that is done, the department cannot require a student to surrender the marks card for substituting revaluation marks for the original marks, where there is any reduction in marks on revaluation.
16. The petitions are accordingly allowed and the endorsements issued by the department calling upon the petitioners to surrender the marks card for substitution of marks obtained on revaluation where the marks obtained by them are less than the original marks (by six marks or more), are quashed and the department is directed to retain the original marks of the petitioners in case of downward revision of marks on revaluation."
Applying the ratio of the aforesaid judgment to the facts of the instant case, I am of the considered opinion that applying the formula of directing declaration of the results by computing / taking average of the 2 highest marks would certainly be more beneficial to the students than a direction to declare the results by computing / taking the average of 4 highest marks and consequently, on this ground also, the impugned order, which is more beneficial to the respondents / students does not warrant interference by this Court in the present petition.

13. Under these circumstances, I am of the considered view that various contentions urged by the review petitioner is without any merit and the same is hereby dismissed.
Accordingly, the review petition stands dismissed.
