% 02.12.2020 (Through Video Conferencing) Crl.M.A. No. 15986/2020 It was observed vide proceedings dated 19.11.2020 that Crl.A. no. 577/2020 had already been disposed of vide judgment dated 22.8.2017, sureties in the instant cases were discharged vide order dated 28.5.2018 as the fine was deposited. The endorsement on the original FDR from account No. 37111355711 has already been cancelled in terms of order dated 20.9.2018 in Crl.M.A. No. 32623 to 32624 of 2018. Qua the present application Crl.M.A. No. 15986/2020 file on behalf of the applicant by the counsel of surety Mr.Ravinder Bhalla seeking directions to the Punjab National Bank, Vaishali, Ghaziabad, to enable him to encash the FDR 1643100053525, it was considered essential that the details of the FDR 1643100053525 were put up by the Registry.

The Registry has now put up the records in the matter i.e., the surety bond executed by Mr.Ravinder Bhalla dated 30.8.2017 indicating that he stood surety for the appellant Rajiv Sapra for an amount of Rs.50,000/- and had submitted the original FDR bearing FDR 1643100053525 dated 11.7.2017 for a period of 24 months drawn on the United Bank of India, Vaishali, Ghaziabad. The Registry has also put up the documents placed at flag B of Part B of the record which indicates that the said FDR was handed over to Mr.Ravinder Bhalla on 5.9.2018. In as much as the surety already stands discharged, the United Bank of India, Vaishali, Ghaziabad is directed to release the amount of the FDR 1643100053525 dated 11.7.2017 to the holder thereof i.e. Mr.Ravinder Bhalla S/o Ram Prakash Bhalla, R/o 3F-H.No.316, Second floor, Sector3 Vaishali Vasundhara, Ghaziabad.
The application is disposed of accordingly.
