HON'BLE MR. JUSTICE SAMEER JAIN Order 16/12/2021 The petitioner has approached this Court by way of the writ petition assailing Section 25(2) of Agriculture University, Jodhpur Act, 2013 in as much as it prescribes qualifications and conditions for appointment of Vice Chancellor of University.
Mr. K.S. Rajpurohit, learned AAG, points out that during pendency of the writ petition, the Vice Chancellor has already been appointed in the University.

(2 of 2) [CW-8027/2019] Learned counsel Mr. Narpat Singh Charan, submits that so far as the grievance of the petitioner regarding experience of 6 years as prescribed in clause 2 (Supra) is concerned, the same stands ventilated by the fact that an amendment has already been proposed in the statute and the requisite experience has been increased to 10 years. The grievance of Mr. Charan that the other conditions of sub-clause 2 of Section 25 are in conflict with the UGC regulations is concerned, the said controversy is no longer res-integra in view of the law laid down by the Division Bench of this Court in the case of Laxmi Narayan Bairwa versus State of Rajasthan & Ors. (D.B. Civil Writ Petition No.14914/2018 decided on 18.09.2019), wherein, it was categorically held that UGC regulation 7.3.0 is recommendatory in nature and the State can deviate therefrom.
In this view of the matter, nothing survives for consideration of this Court in this writ petition, which is rejected as being devoid of merit.
All the pending applications are disposed of. No order as to cost.
