Heard learned counsel for the petitioner, Sri Amit Kumar Singh, the learned Additional Chief Standing Counsel and Sri Ashok Khare, learned Senior Advocate assisted by Sri Pranjal Mehrotra, learned counsel for the U.P. Jal Nigam.
Sri Amit Kumar Singh, the learned Additional Chief Standing Counsel has placed on the record instructions which for the purposes of identification are marked as 'X'.
This batch of writ petitions had come to be preferred before the Court by employees of the U.P. Jal Nigam aggrieved by the inaction on the part of the Corporation to release their retiral benefits. Dealing with the aforesaid issue, this Court today has passed the following order in Writ A No.2557 of 2020 [Dhan Singh Vs. State of U.P. And 3 Others]:-
"Heard learned counsel for the petitioner, the learned Standing Counsel and Sri Pranjal Mehrotra, learned counsel for the Jal Nigam.
Pursuant to the last order passed, the Managing Director of the Jal Nigam has filed his affidavit in which it is disclosed that as on 01 January 2020, retiral dues of 1086 employees remain outstanding and are yet to be paid. It is further submitted that the aforesaid situation has arisen on account of financial constraints being faced by the Jal Nigam. The Managing Director on the affidavit has stated that the retiral dues of all retired employees shall be cleared with expedition and in any case by 31 May 2020.
The aforesaid statement is taken on board. The petition shall consequently stand disposed of accordingly.
The Managing Director is further requested to issue directions to the concerned Regional Offices who shall apprise all retired employees whose dues still remain to be paid of the cut off date which has been noted above and to apprise them of the assurance given before the Court that all retiral benefits shall be released by the cut off date noted above."
Taking the statement of the Managing Director on record, the instant petition shall also consequently stand disposed of on similar terms. Insofar as the issue of payment of interest is concerned, undisputedly, that issue is no longer res integra and stands concluded in light of the decision rendered by a learned Judge in Yogendra Singh And Others Vs. State of U.P. And Others (Writ-A No. 23639 of 2016) wherein the following principles were enunciated:-
"i) Pension and other retiral benefits of all Government employees must be sanctioned / paid in terms of the Rules, 1995 on the eve of their retirement, if there is no legal impediment.
ii) If there is any delay in the payment of retiral benefits and pension, the employee shall be entitled for the interest at the current market rate with effect from the date of his/her retirement till the date of actual payment. The interest on delayed payment shall be paid by the State Government. It will be open to the State Government to recover it from the officer/officials who are found to be guilty for negligence in payment of the pension. If such official is retired, the amount of the interest shall be recovered from his/her post retiral benefits/pension after furnishing him/her opportunity.
iii) It will be open to the State Government to initiate proceedings against such official for taking action for misconduct in terms of the Rules, 1995, if he is in service.
50. In view of the above, respondents are directed to pay the simple interest at the rate of 9% from the one month after the death of petitioners father till the date of actual payment to them and further to pay the GPF within a month ,if it has already not been paid, along with the interest at the rate of 9% as held above."
Since the delay in disbursement rests only on the financial constraints faced by the U.P. Jal Nigam and is not based on any action or inaction on the part of the petitioners-employees, it is only provided that their claim for interest on delayed disbursal shall also duly be attended to bearing in mind the principles enunciated in Yogendra Singh and a decision in that respect communicated to each of the petitioners here within a period of two months from today.
Insofar as the issues flagged in the previous orders passed on this petition including that of 13 January 2020 is concerned, the Court takes on board the statement made by the learned Standing Counsel who on instructions states that the dues which are claimed by the Jal Nigam to be payable to it by the State Government, are being duly assessed and that all endeavour shall be made that those payments are released within a period of six months to one year from today.
Any person aggrieved by the ultimate computation of retiral benefits shall be at liberty to assail the same by way of independent proceedings.
