It has been submitted by the learned counsel for the applicants that since the issue involved in the instant case is identical for all the applicants, their prayers to join together in a single application may be allowed; and is, therefore, allowed.
2. As per the applicants, they are the industrial employees working under MES who belong to Group -'C' and 'D' categories. Vide Office Memorandums dated 02.08.2017 issued by Ministry of Finance, Department of Expenditure and 31.08.2017 issued by the DoP&T, it has been recommended to provide Dress Allowance @Rs. 5000/- per annum to the categories of Group 'C' and 'D' employees.
Learned counsel for the applicants has brought to the notice of this Court that the similar issue has already been decided by the Chandigarh Bench of this Tribunal vide common Order Digitally signed by SOURABH KUMAR Date: 2025.04.30 12:14:51 O.A.No.046/215/2024 +05'30' 35 dated 05.06.2020 in O.A. Nos. 060/01228/2019, 060/1298/2019, 060/1301/2019, 060/01335/2019 etc. as well as by the Lucknow Bench of this Tribunal in O.A. No. 614/2019 vide Order dated 13.12.2022 and another Order dated 03.02.2023 passed by this Tribunal in O.A. No. 043/0020/2023, wherein reliefs sought have been granted to the similarly placed industrial employees of the MES belonging to the Group- 'C' & 'D' categories. It has been further submitted by the learned counsel for the applicants that vide Circular dated 07.02.2022, Lt. Co.I, GSOI(Pers)/EIC for E-IN-C had instructed all the Headquarters of Chief Engineer Office of MES to follow the O.M. dated 02.08.2017 as well as 31.08.2017 in letter and spirit to grant Dress Allowance to the industrial employees working in the MES.
According to the learned counsel for the applicants, the present applicants are also similarly situated with the applicants who approached before the Chandigarh Bench and Lucknow Bench of this Tribunal as they are explicitly covered by the DoP&T's O.M. dated 31.08.2017 as well as Circular dated 07.02.2022. Therefore, learned counsel for the applicants has submitted that it would suffice the purpose of the applicants, if Digitally signed by SOURABH KUMAR Date: 2025.04.30 12:14:51 O.A.No.046/215/2024 +05'30' 36 the respondent authorities be directed to consider the Representation dated 19.08.2024, which is still pending before the respondents, in the light of the aforesaid judgements passed by the co-ordinate Benches of this Tribunal and extend the similar benefit of Dress Allowance to them within a stipulated period of time.
3. Learned counsel for the respondents mentions that as per Ministry of Finance, Department of Expenditure O.M. Letter No. 19051/1/2017-E.IV dated Aug 2017, the industrial employees of MES have not been included in the list of categories eligible for grant of Dress Allowance consequent upon implementation of the recommendation of 7th Pay Commission. However, he has no objection if the O.A. may be disposed of in the manner as stated above.
4. Heard both the learned counsels for the applicants and the respondents. It is noted that in the instant case, all the applicants are working as Industrial Employees in MES and as per the specific Circular dated 07.02.2022 issued by the MES, Director General(Pers)/EIC, it was conveyed that with regard to grant of Dress Allowance to common categories of Group 'C' and 'D', the same shall be implemented in true letter and spirit. 3(Commander Works Engineer, HQ 137, Wks Engrs, C/o 99 APO)/Competent Authority is hereby directed to respond to the Representation dated 19.08.2024 by taking the instant O.A. as a part of it and consider the case of the applicants in the light of the aforementioned judgements and orders passed by the coordinate benches i.e. CAT Chandigarh Bench and Lucknow Bench as well as DoP&T's O.M. dated 31.08.2017 and Circular dated 07.02.2022, and, communicate their decision to the applicants with a follow up action by passing a reasoned and speaking order within a period of Four(04) months from the date of receipt of a copy of this Order.
