Applicant Nazim is in judicial custody in FIR No.349 of 2019, under Sections 419, 420, 467, 468, 471, 120-B IPC, Police Station Sahaspur, District Dehradun. He has sought short term bail on the ground of his illness.
2. Heard learned counsel for the parties and perused the record.
3. It is argued that the applicant is suffering from paralysis on left part of his body. A Medical Certificate, issued by the Senior Medical Officer, District Jail, Dehradun, Uttarakhand has been filed.
4. Learned counsel for the applicant would submit that, in fact, the applicant has already been 2 granted short term bail on 21.05.2022 in BAST No.24 of 2022, because there are few other cases against him, he may not secure his release.
5. Having considered, without adverting to the merits of the case, purely on the humanitarian ground, this Court is of the view that the applicant may be enlarged on short term bail for a period of eight weeks from the date of his release.
6. Let the applicant Nazim be released on short term bail for a period of eight weeks from the date of his release, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the court concerned. It is further directed that, on expiry of eight weeks, the applicant shall surrender before the court concerned and intimation to this effect shall also be given to this Court.
7. The short term bail application stands disposed of.
