Heard Shn Walia, He submits that the earlier OA filed by other applicants Le, OA No. 100/2019, the Tribunal had disposed it of by order of LL.02.2019 directing the respondenis to consider the case of the applicants in that OA and as observed in paragraoh No.19 of that order to grant the benefit of son-finctional grade of Rs.5,400/- to the applicants therein. He further submits that in another OA No.303/2018, the Tribunal had also directed the respandents to extend the benefit of son-funetional grade of Rs.5.400/- to the applicants as per the decision of Madras High Court.

3. Shri Walia further contends that in these two orders, the Tribunal. had specifically directed the respondents to extend the benefit of non-
functional grade of Rs.5 400/- not only to the applicants in those OAs but also to similarly placed other enmplayees. However, the respondents have mot extended this benefit to the present applicants taking a stand that it cannot be extended to those in whose favour there are no specific orders efea Court.or Tribunal.
4, MA No.403/2021 has been filed by the applicant for submitting this OA jointly. [tis allowed. .

In view of the orders passed by the orders of the Tribunals in the above mentioned OAs, Shri Walia seeks direction throneh this OA to the respondents to extend the benefit of non-functional grade of Rs.5,400/- to the present appheants who are similarly placed with the applicants in the above two OAs as per other OAs.
& In view of these submissions, this OA is disposed of at admission stage with direction to the respondents to examine eligibility of the applicants for their entitlement for grant of non-fimetional grade of Rs.5,400+ and if they are similarly placed toe others who bave been extended this benefit based on the orders in OA Nos,100/2019 and S503/2018, they should extend this benefit to the present applicants as well. The respondents should complete this exercise within three months from the date of receipt of a copy of this order and thereafter within two weeks communicate such order to the applicants. No casts.
