UPON hearing the counsel the Court made the following
O R D E R
The present special leave petition is directed against the order dated 30th September, 2009, passed by the Signature Not Verified Division Bench of the High Court at New Delhi in W.P.(C) Digitally signed by Chetan Kumar Date: 2015.11.17 17:23:43 IST Reason: No.6777 of 2014, whereby the High Court has stayed the proceedings for contempt before the Central Administrative Tribunal. Additionally, the High Court has also stayed the SLP(C) 31466/2014 2 operation of the order passed by the Tribunal where-under it had exonerated the petitioner.
It is submitted by Ms. Ayushi Kiran, learned counsel appearing for the petitioner that the conditions precedent for grant of interim order were not satisfied. Mr. A.K. Panda, learned senior counsel appearing for the Union of India would support the order passed by the High Court.
Having heard learned counsel for the parties, in our considered opinion, the cause of justice would be best sub-served regard being had to the factual matrix if the High Court is requested to dispose of the writ petition by end of February, 2016. Be it noted, we have made such a request as we have been apprised that the High Court has fixed the next date of hearing on 13th January, 2016.
The interim order passed by the High Court shall remain in force till end of February, 2016. Neither the petitioner nor the respondent shall seek any adjournment before the High Court.
The special leave petition, as well as I.A. No.2 of 2015 for direction are, accordingly, disposed of.
