(PER : HONOURABLE THE CHIEF JUSTICE MR. R.SUBHASH REDDY) Heard learned senior counsel Shri Sanjanwala appearing for the appellant and Shri Tattvam Patel, learned counsel appearing on caveat for the unofficial respondents.
By perusal of the impugned order, it appears that the learned Single Judge, mainly placing reliance on the judgment of the Division Page 1 of 2 HC-NIC Page 1 of 2 Created On Thu Feb 09 00:31:32 IST 2017 C/LPA/143/2017 ORDER Bench of this Court in case of Rajenbhai Balevbhai Shah v/s Baijiben Kabhaibhai Patanvadia and Ors., reported in 2009(2) GLR 1784, has dismissed the petition filed by the petitioner. It is brought to our notice that against the said judgment of the Division Bench, the matter is carried in Special Leave Petition which is pending before the Hon'ble Supreme Court and the orders of status quo are passed in the matter.
In view of the above, we deem it proper that this matter requires consideration. Notice to the respondent nos.2 and 3 returnable on 16.3.2017. In the meanwhile, there shall be interim relief in terms of paragraph 7(B) in Civil Application No.1978 of 2017.
