1. Heard the learned counsel for the applicant and also perused the record.
2. MA 760/2023 has been filed for revival of CP 112/2014 which was disposed of on 20.07.2017 with an order that CP is dropped with liberty to revive the same if he is still aggrieved aft after er Hon'ble High Court disposes of this matter vide Annexure Annexure-C/3 C/3 of this MA.
3. As apprised by the learned counsel for the applicant that applicant has since superannuated and the original order is subject matter of willful disobedience in CP 112/2014 (in OA No.535/1999) // 2 // MA/050/00760/2023 that contained in brief conducting of a special examination. This order has now become un un-implementable implementable in view of the facts that applicant superannuated in the year 2010 itself. Th The order passed in OA became me the subject matter of furth further er litigation that continued beyond his superannuation.
4. In view of the observation made above, it is clear that this order has no longer remained implementable after it was finally decided by the superior judicial forum. Hence, respondents now cannot be he held ld responsible for willful disobedience of the order.
5. Hence, MA for revival of CP is dismissed.
6. Pending MA also stands disposed of.
