                      W.P.(C). NO. 16249 OF 2010
                   --------------------------------------------

Dated this the 27th day of May, 2010

                                JUDGMENT

The petitioner is working as Lecturer in Electronics (Selection Grade) in the College of Engineering, Kottarakkara under the Institute of Human Resources Development for Electronics. Earlier, he has submitted Ext.P4 application for transfer from the said college to the College of Engineering, Karunagappally. The grievance of the petitioner is that though he is the senior and entitled to get a transfer to his native place going by the transfer norms, his claim was overlooked and the second respondent was transferred and posted against the said vacancy at College of Engineering, Karunagappally as per Ext.P5. In short, the contention is regarding the violation of the rule of seniority. The petitioner also contends that his claim is liable to be considered on compassion as well. It is the further contention of the petitioner that even if the second respondent is accommodated in the said college, there are other vacancies against which the petitioner can be accommodated in the said College. These are matters for consideration by the first respondent. Hence, this W.P.(C) NO.16249/2010 2 Writ Petition is disposed of as follows:- If the petitioner files a representation against Ext.P5 pointing out the aforesaid aspects within a period of three weeks from today, the same shall be considered by the first respondent with notice to the second respondent expeditiously, at any rate, within a period of two months from the date of receipt of a copy of this judgment.
