                                  JUDGMENT

1. The above case has been Suo Motu registered by this Tribunal on the basis of the news paper report published in Dinamalar Chennai Edition dated, 13.07.2020 under the caption "guhkupg;gpd;wp ca;af;nfhz;lhd; fhy;tha;

2. It was alleged in the newspaper report that due to non-maintenance of Uyyakondan Canal in Tiruchirappalli, the commencement of seasonal cultivation in that area has been delayed. Further, it was alleged in the report that Uyyakondan canal was built by the Great King Raja Raja Chozhan for the purpose of irrigation, drinking water and also to raise the groundwater. The canal splits from the river Cauvery and starts at Pettavaithalai and travels through Vazhavanthankottai Lake and flows up to Cherandi Lake, Thanjavur District stretching the distance to 71Km.

3. There are 120 branch canals originating from this whole stretch. According to the report, 32,742 acres of agricultural lands are getting water for irrigation from this canal. This canal runs 8 km within the limit of Thiruchirappalli Corporation and in most of the area, it is getting polluted due to mixing of sewage water. Now the canal is covered with water hyacinth weeds and choked due to Garbage dumping.

4. Though a scheme was announced during 2014 -2015 by the then Chief Minister, Late. Miss. Jayalalitha and sanctioned Rs.11,00,00,000/-(Rs. Eleven Crores Only) for the purpose of desilting the canal and maintenance of the canal, only partial work was carried out and thereafter, it was left without any maintenance.

5. This Tribunal after reiterating the dictum laid down in the decisions of the Hon'ble Apex Court as well as various Hon'ble High Courts and National Green Tribunal regarding the responsibility of the State Government and its departments to protect the water bodies and also the raising concern regarding dumping of waste and treating this irrigation canal as sewage canal, admitted the matter and appointed a Joint Committee comprising of (1) The District Collector, Thiruchirappalli District or an Officer not below the rank of Assistant Collector or Sub-Divisional Magistrate of that area nominated by the District Collector, (2) Superintending Engineer of Public Works Department and Water Resources Organisation, (3) A Senior Officer deputed by the Chairman, Tamil Nadu Pollution Control Board and (4) The Commissioner or a Senior Officer deputed by the Commissioner Thiruchirappalli City Corporation to inspect the area in question and submit a factual as well as action taken report if any violation is found.

6. Further, this Tribunal had directed the committee to ascertain the following things :-

a. To ascertain the genuineness of allegation regarding the dumping of waste and discharge of untreated sewage into the water body resulting in contamination of the water in the water body.
b. To trace out those persons who are responsible for the same and assess the environmental compensation and take steps to recover the same from such persons in accordance with law.
c. To ascertain as to whether there is any scheme launched by the Government or the District administration to protect the water body and if so, what is the present status of its implementation.
d. To assess the water quality and if there is any contamination, suggest the ways and means to remedy the same.

7. The Public Works Department was designated as the nodal agency for co-

ordination and also for providing all necessary logistics for this purpose.

8. The case was posted to 08.10.2020 for consideration of report. As per order dated 24.07.2020, certain corrections regarding the appearance of parties through standing counsel was carried out.

9. On 08.10.2020, this Tribunal had considered the Joint Committee report dated Nil, received on 06.10.2020 and extracted in Para 5 of the order which reads as follows:-

It is respectfully submitted that based on the Hon‟ble National Green Tribunal order dated 24.07.2020 the Joint Committee has been constituted by the District Collector, Tiruchirapalli District vide ROC No: E7/6311/2015 (Main) dated 28.08.2020 (Enclosure No.1) and 1st meeting had been convened on 04.09.2020 with following committee members

1. Revenue Divisional Officer, Trichy, (Chairman)

2. Superintending Engineer, PWD/WRD Middle Cauvery Basin Circle, Trichy, (Member)

3. District Environmental Engineer, YNPCB, Trichy, (Member)

4. City Engineer, Tiruchirapalli City Corporation, (Member) At O/o the Superintending Engineer, PWD/WRD, Middle Cauvery Basin Circle, Trichy. In the meeting it was directed to evolve the detailed action plan and discussions has been made for the present state of affairs and also the genuineness of the allegation mentioned and it has been proposed to inspect the Uyyakondan Canal stretch as ordered by the Hon‟ble National Green Tribunal.

2.0 INTRODUCTION ABOUT THE UYYAKONDAN CANAL The Uyyakondan canal was built by the Great King Raja Raja Chozhan for the purpose of irrigation of 32742 acres including 36 no‟s of Tanks indirectly in Tiruchirapalli and Thanjavur District. The Canal is taking off from the River Cauvery with an open head at 171th KM from Mettur reservoir on the right side of river Cauvery. The actual head is situated at Pettavaithalai Village in Srirangam Taluk. It has got a long length of leading canal running along the right margin of Cauvery and at Km 2.83 and the head sluice was constructed in the year 1932. The main canal runs for a length of 71 km and tail ends into Valavanthankottai tank situated in Valavanthankottai village in Trichy Taluk. The Uyyakondan canal from LS 16/4 to 21/4 miles (26.54 km to 34.50 km) runs within the limit of Tiruchirapalli City Corporation.

In the year 1937 a new extension canal formed from Valavanthankottaito Santhan eri covering a length of 7 miles 6 furlongs and 480 feet. This extension canal was intended to supply 13 rain fed tanks one in Trichy District and 12 in Tanjore District. Subsequent to the above in the year 1951 a second extension canal was sanctioned and executed for a length 1 mile and 2 furlong Santhan Eri to Sayakudi Eri and the III rd Extension Canal for a length of 1 mile and 1 furlong from Sayakudi Eri to Serndi Eri.

When the South Bank Canal was excavated and Kattalai Bed Regulator was constructed in the year 1934 - 1935 all Korambu canals below Kattalai Bed Regulator up to Uyyakondan head from Page 5 of 47 Pettavaithalai in Srirangam Taluk on the right side of Cauvery has been shifted to South Bank Canal and the required supply to Uyyakondan was drawn at head in South Bank Canal and let down at the tail drop in South Bank Canal into Kulithalai Kattuvari which joins with the leading canal of Uyyakondan just above the head sluice a surplus escape was also constructed to facilitate letting out into Cauvery.

3.0 Observations made in relevant NGT Order. (Para) 2.

It is alleged in the news paper report that due to non- maintenance of Uyyakondan Canal in Tiruchirapalli, the commencement of seasonal cultivation in that area has been delayed.

It is respectfully submit that there is no delay in the seasonal cultivation in the Tiruchirapalli as the Uyyakondan canal has been maintained periodically by removing silts at necessary places and removal of weeds being done periodically within the city corporation limits since the water hyacinth is arriving is stagnated water only.

It has been also submit that during this year, for irrigation in delta districts the water was opened at Mettur dam on 12.06.2020 for Kuruvai crop. And the water was withdrawn from the Cauvery River at South Bank canal to feed Uyyakondan canal on 28.06.2020. Also the water travelled through 71 km and reached the tail end of Valvanthankottai tank on 28.07.2020. The water was released through the Uyyakondan extension canal on 24.08.2020 after impounding the Valavanthakottai Tank. And as per the statement received from the Joint Director Agriculture for Tiruchirappalli District, during this current fasili year (1430) ayacut of about 180.82.5 Hectares of Kuruvai crop have been cultivated in the Tiruchirappalli District. (Enclosure No.2) (Para) 4.

The canal splits from the river Cauvery and starts at Pettavaithalai and travels through Vazhavanthankottai Lake and flows up to Cherandi Lake, Thanjavur District stretching the distance to 71 Km.

It is respectfully submit that at present the Uyyakondan canal off takes from the tail end of South Bank Canal at Pettavaithalai village in Srirangam Taluk (whereas the South Bank Canal off takes at Left Bank of Kattalai Bed Regulator at Mayanoor in Karur District). The Uyyakondan canal runs through a length 71 km and falls into Valavathankottai tank and after that the Uyyakondan 1st Extension Canal off takes and travel through a length of 11.46 Km and Uyyakondan 3rd Extension canal though a length of 1.80 Km. (Para) 5.

It is respectfully submit that there are about 126 direct sluices canals and 10 tank sluice off takes from the Uyyakondan canal. The Uyyakondan canal runs through a length of 8 Km within the limits of Tiruchirappalli Corporation and in some places, it is getting polluted by the stagnated water.

The Uyyakondan canal travels along through its own contour. Hence the bed fall of the canal is very low. The bed fall of the canal inside the Trichy City Corporation is about 1 in 7850 (i.e., 1 m bed fall for the length of 7.85 Km). Thus the water is flowing only when the depth raises otherwise its velocity will be very low. During the irrigation season there will be proper flow in the Uyyakondan canal. And during non season there will be stagnation of water inside the canal. Thus during non seasonal period thee will be possibility of stagnation of water inside the canal. This stagnate water will leads to the growth to seeds. Hence these weeds will grow and spread along the canal. Also the weeds will enter from the Cauvery River and from the various drains joining the river. During the regular flow in canal these weeds will float at top of the water level and there is no hindrance to the flow of water inside the canal. During the flow of water in the canal the grown up weeds will float to the top of the water level. Hence, the weeds can be removed easily and effectively. These floating weeds are being removed in order to ensure safety to the public by preventing from the insects, reptiles and mosquito growth. This year the water into this canal has been reached to its tail and area and cultivation activities have been done by the farmers at right time.

The Uyyakondal Canal runs admittedly 8 Km within the limits of Tiruchirappalli City Corporation comprising of K-Abishekapuram Zone, Ponmalai Zone and Ariyamangalam Zone.

Presently, Under AMRUT Phase II UGSS (Under Ground Sewerage System) Project, UGD (Under Ground Drainage) works are being executed from Puthur Weir to Lawson‟s Road, near Ayyappan temple in Ponmalai Zone along the Uyyakondan Canal bund side. Works are also being executed in Ariyamangalam Zone under this Project along this canal bound. The sullage from Siddha hospital and TB hospital functioning inside the Government Hospital is connected with the sewer lines running in Allithurai road and the said sewage waters were stopped from going to the Uyyakondan Canal. The sewage Page 7 of 47 of Maruthi Hospital and Rathina Global Hospital located near Uyyakondan Canal is not let into the canal and they have connected it in the UGD lines of this Corporation by following the said sewage line are connected to the Panjappur sewage treatment plant in Trichy.

It is submitted that under the Smart City development scheme a Plan to revamping the existing sewage system which are commissioned during the year 1987 were found out and a detailed study has been conducted and a proposal has been submitted for carrying out the said works. The said work was technically approved under the Smart City scheme and expecting the consent from the High Power Committee for carrying out the works at the earliest. The said proposal was submitted even on 21.07.2020 and will be taken on consideration within this month by the High Power Committee, Uyyakondan canal and its neighbouring areas are covered under AMRUT PHASE -II Scheme and Smart City UGSS scheme. By completing the above schemes all the areas covered under the present Trichy Corporation limits will be connected to UGD SCHEME and no untreated water will be let out in Uyyakondan canal at all the 36 points mentioned (Enclosure No.3). The work is under way in Phase-II scheme is already in the process for 9 points and balance 26 points will taken up in Smart City UGSS Scheme.

It is submitted that actions has been taken against the individual house hold who are not connected their sewage lines in to the existing UGD‟s. As such we found 1627 households in and around Uyyakondan canal were letting the sewage line in to the canal.

In the result of the action taken by the corporation out of 1627 total number of Households adjacent to the bank of Uyyakondan Canal, 1040 UGD Connections were given and 587 Public Health Notices are being issued to the individual households and 163 connections which are letting into Uyyakondan Canal were closed. It is respectfully submit to state that the drainage lines in that area adjacent to the Uyyakondan canal were laid more than 30 years back and are now developing lots of stoppages and leakages around that area. Tiruchirapalli City Corporation are maintaining that old sewage system till now and now developed scheme under AMRUT PHASE - II Scheme till now and Smart City UGSS scheme for revamping the entire drainage and sewage system. After the completion of the above two schemes no sewage mixed water will be let in the Uyyakondan canal at any points.

It is respectfully submit that trough 8 Kilometres stretch of Uyyakondan canal lines within the limit of Trichy Corporation, the weeds and Hyacinth were removed then and there by the Public Works Page 8 of 47 Department. Besides this action is taken against the individual households who are letting untreated sewage into the water body by City Health Officer of Tiruchirppalli City Corporation by way of issuing notice to stop such water contamination and to get UGD connection. Action is being taken in full swing to stop the untreated sewage water into the water body by  Blocking the pipes which are directly let into canal  By issuing more notices under Public Health Act  By giving UGD Connections  Removing garbage from river bund using JCP and Tipper Lorry Action is taken against persons who are responsible for the contamination of water by issuing notices by City Health Officer of Tiruchirapalli City Corporation as listed in the enclosure. Within the limits of Golden Rock Zone, by such action taken, Ward No.46, Ponvizha Nagar Bund side - 7 Nos. - Ward No. 48, Pakkali Street - 12 Nos. and within the limits of Ariyamangalam Zone - Ward No.21 - 15 Nos. Ward No. 23, Vaikkal Mettu Street - 32 Nos. & Eda Street South Corner - 85 Nos. Ward No. 22, Anna Nagar - 12 Nos. of households which are letting the waste water into the water body were found out and the same were stopped by giving connections to the UGD.

WASTE DISPOSAL It is respectfully submit that in and around the canal the garbage„s gathered by the Corporation staff and cleared in alternative days. The garbage‟s and debris gathered on the banks of the canal are removed periodically by the corporation by using JCB, Tippers and dozer vehicle. In part of ARRUT PHASE - II scheme the said works are carried out on the banks are present also. Other than this process there is one Micro Compost Yard in Ward No. 49 Kulumikkarai, near Alwar Thoppu for proper processing and disposal of solid wastes.

Regarding discharge of Treated Sewage water from Annal Gandhi Memorial Government General Hospital, Tiruchirappalli It is respectfully submit that the Annal Gandhi Memorial Government, Tiruchirappalli is now letting the treated sewage into the Uyyakondan canal. Thus in order to avoid the treated sewage it is proposed to give underground drainage connections to the entire premises from the existing hospital outlet to the Corporation UGD Sub Pumping station collection well which is located at Vayaloor main road at a distance of 1165m. And it is submit that the Tiruchirappalli City Corporation has given a revised estimate for a sum of Rs. 94.60 Lakhs for laying separate UGD connection to the Government Hospital. And Page 9 of 47 the proposal was sent for approval for the above said amount to the national Health Mission. After getting the necessary approval the treated sewage will be connected to the Underground Drainage.

Other Locations in Corporation Limit And also it is submitted that totally there were 36 intersection points where the sewage water is flown into the Uyyakondan canal in the 8 Kilometres stretch. Out of 36 points now one point have been closed under the AMRUT- II scheme underground drainage system viz Raja colony and Kumuli thoppu area. Twenty Six point will be curtailed in the ongoing Smart City UGSS Scheme within 31.12.2021. Eight point where the sewage line connecting to Uyyakondan canal will be stopped on completion of AMRUT- UGSS PHASE - II before 31.12.2021, in which the work is under progress. Committee inspected at the points of SWD i.e., Storm Water Drain on the way of Uyyakondam Canal.

(Para) 6. Though there was a scheme announced during 2014- 2015 by the then Chief Minister, Late. Miss. Jayalalitha and sanctioned Rs. 11,00,00,000/- (Rs. Eleven Crores Only) for the purpose of desilting the canal and maintenance of the canal, only partial work was carried out and thereafter, it was left without any maintenance.

It is respectfully submit that during the budget session 2014 - 2015, the Hon‟ble Chief Minister of Tamil Nadu in the floor of Assembly on 04.08.2014 under rule. 110 was announced that "Rehabilitation and Modernization of Uyyakondan Canal in Palakarai Area of Trichy City at the cost of Rs. 1250.00 lakhs (Rs. 12.50 Crores) and the Government of Tamil Nadu has a accorded administrative sanction at a cost of Rs. 11.50 Crores for this works under loan assistance from NABARD (RIDE XX) for the year 2014 - 15 vide G.O (MS) No. 80 dated 16.04.2015. The work had been commenced and completed on 16.02.2017.

The width of the Uyyakondan canal inside the city corporation has been gradually reduced. Thus in order to maintain the full water supply without any obstructions and land slide of the banks. It has been proposed to construct the retaining wall along the heart zone of the Tiruchirappalli City. Hence this Uyyakondal canal was inspected by Chief Engineer, Plan Formulation, Chennai. After considering the facts and in order to prevent the land sliding at the banks of the canal due to urbanization, it was decided to construct the retaining along the both banks of the Uyyakondan canal for a length of 1650m. And the desilting had been done by using floats as there is water stagnation inside the canal. And the de-silted silt had been conveyed to nearby low Page 10 of 47 lying areas. Based on the above considerations these work has been included in this project. The following are the component of work which were involved in the project.

In this project protection wall has been provided to 1650m on both sides of Uyyakondan canal from LS 19/1 mile to LS 20/2 mile and desilting works have been carried out for the length of 8Km from LS 17/1 mile 20/5 mile. Because of this now the water in the canal is flowing without any hindrance. And this project had been completed as per the estimate and periodical maintenance will also be done by the Public Works Department/ Water Resources Organization. The completed project photographs have been submitted in Photograph No: 1 to 10 (Para 12) The committee is also directed to ascertain the genuineness of allegation regarding the dumping of waste and discharge of untreated sewage into the water body making contamination of the water in the water body.

It is respectfully submit that on 05.09.2020 and 08.09.2020 the Joint inspection have been made with the committee members. The inspection started from the Uyyakondal canal at LS 16/4 mile where the Trichy City Corporation limits begins. The inter section points where storm water is being confluence with Uyyakondan canal from Puthur aqueduct up to Kumuli Thoppe, at Lawson‟s Road near Ayyappan Temple, Ponvizha Nagar Pudhu Reddy Street, Pakkali Street, Alwar Thoppu Bridge. At the time of inspection it was found that in most of the places garbage is dumped in the river bund, and committee inspected at the points of SWD i.e., Storm Water Drain on the way of Uyyakondan Canal. During the Joint inspection the water samples in the canal have also been collected at following locations and test result have also been furnished in (Enclosure No. 4 and 5). And in order to prevent the dumping of solid waste it has been decided to fix the CCTV Camera at following locations,

1. Near MGR Statue

2. Near Uzhavar Sandhai

3. Near Alwarthoppe Pakkali Street Bridge

4. Palakarai Bridge near Nataraj Hotel

5. Near Eda Street Church Bridge

6. Pitchai Nagar Bridge location And monitoring will be done by the Trichy City Corporation.

Para 13 The committee is also directed to trace out those persons who are responsible for the same and assess the environmental Page 11 of 47 compensation and take steps to recover the same from such persons in accordance with law.

It is respectfully submit that as per the direction of the Tribunal, action is the following actions have been taken by the Tiruchirappalli City Corporation.

 Within the limits of Golden Rock Zone, by such action taken, Ward No. 46, Ponvizha Nagar Bund side - 7Nos - Ward No. 48, Pakali Street - 12 Nos. and within the limits of Ariyamangalam Zone - Ward No.21 - 15 Nos. Ward No. 23, Vaikkal Mettu Street - 32 Nos. & Eda Street South Corner - 85 Nos. - Ward No. 22, Annai Nagar - 12 Nos. and within the limits of Ariyamangalam Zone - Ward No. 21 - 15 Nos. Ward No. 23, Vaikkal Mettu Street - 32 Nos. & Eda Street South Corner - 85 Nos - Ward No. 22, Annai Nagar - 12 Nos. of households which are letting the waste water into the water body were found and the same were stopped by giving connections to the UGD.  Within the limits of Tiruchirapalli City Corporation, out of 1627 total number of Households adjacent to the bank of Uyyakondan Canal, 1040 UGD Connections are given to till date 587 UGD Connections to be given.

587 Public Health Notices are issued till now. 163 connections which are letting into Uyyakondal Canal were closed 36 Corporation Strom Water drain are connected to the Uyyakondan Canal.

Para14 The committee is also directed to ascertain as to whether there is any scheme launched by the Government or the District administration to protect the water body and if so the present status of its implementation.

It is respectfully submit that at present under AMRUT Phase II UGSS Project, UGD works is being executed by the Tirichirappalli City Corporation for an estimate amount of Rs. 85.52 crores at following locations.

 Puthut Weir to Lawson‟s Road (near Ayyappan temple) in Ponmalai Zone.

 Along the Uyyakondan Canal bund side in Ariyamangalamm Zone.

SEWAGE TREATEMENT PLANT Construction of sewage treatment plant of capacity 37 MLD on DBO basis for UGSS in Trichy Corporation under package -3. For an estimate amount of Rs. 53.00 Crores.

Sewage generated from the Tiruchirppalli City will be collected by the sewerage network and shall be taken to (pumping main of size Page 12 of 47 700 mm dia from SPS-4, Rajarajeswari Nagar and another pumping main of size 600 Plant (STP) facility. The sewage from the terminal manhole of the sewer network shall be conveyed to the Receiving Sump cum Pump House (RSPH) and shall be pumped to the inlet chamber of the proposed 37. OMLD STP. The treated sewage will be finally discharged to Uyyakondan Canal by pumping main of 3 Km length. The STP is designated for an average flow of 37.0 MLD with a peak factor of 2.25 (Peak Flow 83.25 MLD). Under this STP the 35 Wards will be benefited after completion of this massive project, moreover the sewage let into the Uyyakondan canal will be enormously reduced.

Based on the contour levels of the City the watersheds have been identified and the natural valleys have been considered for arriving at sewerage zones. The project area for Phase -II has been divided into 13 proposed sewerage zones based on contour levels and hierarchy of the drain system and their tentative locations arrived at for designing the most cost effective system. The proposed sewage collection system, to the extent possible, has been proposed to convey sewage by gravity. To ensure this condition, sewer lines are proposed to be laid with requisite slope to convey the sewage flow with specified self-cleansing velocity. Accordingly, the sewer material has been proposed to resist corrosion, backfill load and dynamic loading.

Zone - 1: This zone consists parts of wards 7, 8, 29 and 61 out of the extended area of the City on the east portion. The zonal area is about 172 Hectares having a 2050 projected population of 30,039. The sewer network proposed is about 12 Km. The contributing streets are Pillaiyar Kovil Street, Mariyamman Kovil Street, Nagamani Street, Palani Andavar Street, VVIP rice mill street, Adaikalamadha Street, Sivakami Ammaiyar Street Anthoniyar Kovil Street, Tirupur Kumaran Street, Pillaiyar Kovil Street, Bharathiyar Street, Arputhasami Puram, Kalaivanar Street, Quaid e Millath Nagar, Nehru Street, VOC Nagar Mothilal Street, Kalaivanar Nagar, Chellaiah Street, Gandhi Nagar, Joseph Krishnan Street, Srinivasa Nagar, Saminathan Street, and portion of Ganapathi Nagar.

Zone - 2: This zone mainly consists of part of wards 7, 27, 29, 30 and 32 out of the extended area of the City on the east portion. The area of the zone is 243 Hectares with an ultimate 2050 projected population Page 13 of 47 of 52,334. The sewage network proposed is 27.5 Km. The contributing area are Patel Nagar, MGR Street, Laxmipuram, VOC Street, Athupalam Street, Kumaran Street, Ukkadai (Ariyamangalam), Rajiv Gandhi Street, Mariyamma Street Kaveri Nagar, Ride mill Street, Pudu Street, Palikuda Street, Anna nagar, Jyothi Nagar, Ambedhkar Nagar, Udaya Nagar, Kalaivanar Street, Pavalam and Sippi Nagar, Periyar Nagar, Pappammal Colony, Golden Nagar, Sastri Street, Ratnaswamy Street, Jagannathpuram, Muneeswara Koil Street, Ambikapram, Anna Street and Rathinam Street, Nehru Street.

The sewage collected from Patel Nagar, Laxmipuram, Athupalam is collected by gravity and discharged to lift station 2, which in turn is pumped to a ridge manhole. From ridge manhole the flow reaches lift station 3 by gravity. The sewage flow from Ukkadai (Ariyamangalam), Udaya Nagar, Pavalam and Sippi Nagar is discharged into lift station 3 by gravity, which is turn pumped to a ridge manhole. From ridge manhole the flow reaches SPS2by gravity. The sewage generated from Jagannathapuram, Golden Nagar, Ambikapuram, Kaveri Nagar is discharged to SPS2 by gravity trunk main. From SPS2, the flow is pumped to a ridge manhole and from ridge manhole the flow reaches SPS6 by gravity.

Zone - 3: This zone mainly covers part of north side of Thanjavur and includes part of wards 7, 28, 29, 30, 32, 61, 62, 63 64 and 65 out of the extended area of the city. The area of zone is 882 Hectares with an ultimate 2050 projected population of 1,43,370. The sewage network proposed 109.5 Km. The contributing area are Part of Kamarajar Nagar and Neduncheliyan Street Ganapathi Nagar, Police Colony Street, KVK Sami Street, Saminathan Street, Kalyana Sundaram Street, Gandhi Street, G.T. The flow from lift station 1 is pumped to SPS 1. Nagar, V. Swaminathan avenue. Due to low population density these area will be handled through sewage management and later will be provided with underground sewerage system when the population density increases.

RIVER FRONT DEVELOPMENT Implementation of River front development project at Uyyakondan Canal is being executed at an estimated cost of Rs. 17.56 Crores to prevent canal pollution. Work under was issued to M/s. PST Engineering, Namakkal on 07.01.2019 and so far 60% of work has been completed and total project will be completed on March 2021. (Photographs enclosed no: 72 to 76) Various entertainment in the name of Tiger Park, Peacock Park and Lotus Park are being created in the 2.10 Km stretch on both side of Uyyakondan Canal.

After the completion of project, Tiruchirappalli people will immensely benefit from the works executed here and they will enjoy very much with the entertainment structures created along with natural air.

The major Components of the project are follows:

 Provision of RCC retaining wall in the project area, wherever necessary to sustain the improvements such s Walkways/Green Space/ Water front.
 Development of Roads on both the banks of the proposed site to improve the mobility and connectivity.
 Jogging, Walking and Pedestrian Pathways at the proposed site along the banks of the Canal.
 Landscaping in the proposal stretch of the canal.  Parking facility for people using river front facilities.

 Open stage with amphitheatre to conduct various shows at the bank of the canal.
 Provision of E-Toilets.
 Children‟s play area / play Equipment.
 Public Park and Green Space development.
 Seating arrangements for the visitors.
To prevent the pollution at Uyyakondan Canal, the Corporation decided to improve and develop the canal area under river front development component of Smart City Mission. The Corporation will conduct the awareness programme and displaying the boards so s to avoid the dumping of polluted things into the canal by the public.
Para 15 The committee is also directed to assess the water quality and if there is any contamination suggest the ways and means to remedy the same.
It is respectfully submit that the during the field inspection the water samples has been collected by the TNPCB, and following observations and recommendations has been made, Observation
1. Water hyacinth growth is observed in some stretches of the Uyyakondan canal during inspection on 05.09.2020 & 08.09.2020 which lowers the dissolved oxygen level. After removal of the Water hyacinth growth in the Uyyakondan Canal, samples collected on 0310.2020, as per the Report of analysis DO is above 3 mg/L.
2. In the unsewered areas of Trichy Corporation, the residents are disposing their bathroom and kitchen waste water in open drains, constructed by Trichy City Corporation. The septic tanks outlet of residents also reaches the Uyyakondan canal. The septic tanks outlet of residents also reaches the Uyyakondan canal. E Coli present in the Uyyakondan canal water indicates sewage mixing in the canal water.
3. Government Head Quarters Hospital is letting out the treated sewage in the Uyyakondan canal.
4. In sewered areas some of the households are letting their bathroom and kitchen waste water to road side drain finally mixing into the uyyakondan canal.
5. The leakage from ole Under Ground Drain pipes in some places reaches Uyyakondan canal.
6. Municipal solid wastes are found to be dumped in some areas of the canal.

Recommended Actions

1. Public Works Department has to remove the water hyacinth from the canal periodically.

2. The mixing of sewage and other waste water in the Uyyakondan Canal will be arrested, if a sewerage system is extended to the unsewered area. Trichy Corporation has to take action to expedite the completion of Phase - II UGSS to unsewered areas.

3. The Trichy Corporation has to take action to maintain the UGD system properly.

4. It is necessary to stop / arrest the entry of domestic sewage and dumping solid waste in to the canal from households and continuously monitor the quality of canal water to preserve this resource from further pollution.

5. Trichy Corporation has to implement the Municipal Solid Waste Management Rules, 2016 strictly and strict action may be taken against the violators.

6. Government Head Quarters Hospital has to take necessary action to reuse the treated sewage without discharging into Uyyakondan canal.

The results are submitted in Enclosure No. 4 (before weeds removal and 5 (after weeds Removal).

4.1 Action Taken by Public Works Department / Water Resources Organization Removal of water hyacinth (weeds).

 The growth of water hyacinth (weeds) over the Uyyakondan canal for a length of 8 Km in the Trichy City Limit has been removed by men and machinery.

(As shown in photograph no: 33 to 49) Eviction of Encroachments.

 There are about 27 nos. of encroachments have been identified on the both sides of the canal. Under Tamil Nadu Land Encroachment Act 1905 notice no. VII (Prior notice to person in occupation) has been served to the encroachers by the Public Works Department. And as per above act stringed action will be initiated subsequently and encroachment will be evicted within a period of 28 days from the issue Notice.

 1 Dozer Engine was pressed into service to clear garbage in the canal from 08.09.2020 to 12.09.2020.

 4 Nos. of JCBs, 11 Nos. of Tippers and 1 No. of Dozer were engaged since 13.09.2020 and garbage was removed through 171 trips and still the work is going on.

 So far 1.10 Km stretch of canal was cleaned by 10 Nos. of Corporation Cleaning Workers.

 4 Nos. of JCBs and 11 Nos. of Tippers will be engaged for removal of solid wastes lying along the banks of Uyyakondan Canal.  All the remaining works will be completed by 30.09.2020 and it will be ensured that sewage is not let into Uyyakondan canal henceforth (As shown in Photograph No. 50 to 61) Removal of Liquid Waste.

Action is being taken in full swing to stop the untreated sewage water into the water body by  Blocking the pipes which are directly let in to canal.  By issuing more notices under Public Health Act.  By giving UGD connections.

To prevent the pollution in Uyyakondan canal, it has been decided to improve and develop the canal bank area under River Font Development Component of Smart City Mission. Also it is decided to conduct the awareness programme for public by displaying the boards for not to throw the debris and garbage‟s, household wastes etc., into the Uyyakondan canal by the public.

5.1 Sewage Management The Tiruchirapalli Corporation will complete the UGSS (Under Ground Sewerage System) and operate the STP (Sewage Treatment Plant) provided to prevent the discharge of un-treated sewage into the canal. The Tiruchirappalli City Corporation shall provide underground sewerage system for all un-sewered area and the additional sewage flow shall be treated through additional Sewage Treatment Plant (STP).

5.2 Solid Waste Management The 3 zones of Tiruchirappalli City Corporation will dispose their solid wastes in a scientific manner and will avoid dumping of solid wastes along the canal stretch. The quality of canal water can be improved by intercepting the sewage treatment plants for the respective zones and stop the dumping of corporation solid wastes near the canal banks."

10. After, considering the above report, this Tribunal had passed the following order:-

"6. Though, it was mentioned in the report that certain steps have been taken under the AMRUT Scheme and also under the Smart City Scheme and River Fund Development Scheme but they have not provided the time line within which these things can be completed and what are all the temporary measures to be taken for the purpose of avoiding discharge of untreated sewage into the canal which makes the canal polluted.
7. They have also mentioned in the report that discharge of untreated sewage water from the Annal Gandhi Memorial Government General Hospital, Thiruchirappalli is being let-in into this Canal and there is no provision provided there for treatment of the sewage generated within the compound itself and there is no underground drainage system provided to connect the same with the main drainage system maintained by the Thriuchirappalli Corporation/6th respondent as well.

8. When this was pointed out, Sri. Saravanan, the learned counsel appearing for the Thiruchirappalli Corporation/6th respondent submitted that there is already a Writ Petition pending before the Hon‟ble High Court of Madras at Madurai Bench as W.P. No.8980 of 2020 in which the Hon‟ble High Court had directed to report about the action taken against the said hospital for illegal discharge of sewage into the water canal by them and that case was posted to 14.10.2020 for consideration of that report.
9. The learned counsel appearing for the Thiruchirappalli Corporation/6th respondent also submitted that if some time is granted, they will come with a proper action plan for mitigating the circumstances mentioned in the paper report and keep the canal maintained in a proper way by making it encroachment free as well as pollution free.
10. In the mean time, the Pollution Control Board is directed to submit an independent report regarding the action taken by them for non-compliance of the Solid Waste Management Rules, 2016 by the said hospital namely, Annal Gandhi Memorial Government General Hospital, Thiruchirappalli for discharging the untreated sewage into the canal and also not providing any underground sewage treatment facility to connect the same with the common underground sewage provided by the Corporation to avoid these things and also the implementation of the Solid Waste Management Rules, 2016 and directions of the Principal Bench of National Green Tribunal, New Delhi in O.A. No.606/2018 in the 6th respondent corporation and what is the action taken, if it is not complied with.
11. Thiruchirappalli Corporation as well as the Tamil Nadu Pollution Control Board are directed to submit their further action taken report to mitigate the situation alleged in the newspaper report and make the canal free from pollution with specific time line.
12. The corporation is also directed to mention in the status report to be filed as to what are all the temporary measures taken by them in respect of those outlets which are not connected with the underground sewage so as to avoid the same being discharged into the canal."

11. The case was posted to 18.11.2020 for consideration of further status report.

Thereafter, the matter was taken up on 12.02.2021 and considered the status report cum action taken report filed on behalf of the 6th respondent on 17.11.2020 and received on 01.12.2020 and the same was extracted in Para 3 of the order which reads as follows:-

5. I humbly submit that the Joint Committee has conducted a joint inspection on 5.9.2020 and 8.9.2020 and filed its report before this Hon‟ble Tribunal. This respondent is also a member of the joint committee has submitted the present status of the projects which are under progress along with necessary documents to the members of the Joint Committee and the same was also a part of the report. However, this Honble Tribunal has specifically directed this respondent to file the present status and time line in respect of the projects, hence this respondent filing the present status report.
6. I humbly submit that the report submitted b the Joint Committee may be treated as part and parcel of this status report.
7. I respectfully submit that the Uyyakondan canal was built by the Great King Raja Raja Chozhan for the purpose of irrigation of 32742 acres including 36 no‟s of Tanks indirectly in Tiruchirapalli and Thanjavur District .The Canal is taking off from the River Cauvery with an open head at 171th KM from Mettur reservoir on the right side of river Cauvery. The actual head is situated at Pettavaithalai village in Srirangam Taluk. It has got a long length of leading canal running along the right margin of Cauvery and at km 2.83 and the head sluice was constructed in the year 1932. The main canal runs for a length of 70 km and tails into Valavanthankottai tank situated in Valavanthankottai village in Trichy Taluk. The Uyyakondan canal from LS 16/4 to 21/4 miles (26.54 Km to 34.59km) runs within the limit of Tiruchirapalli City Corporation.
8. In the year 1937 a new extension canal formed from Valavanthankottai to Santhan eri covering a length of 7 miles 6 furlongs and 480 feet. This extension canal was intended to supply 13 rain fed tanks one in Trichy District and 12 in Tanjore District. Subsequent to the above in the year 1951 a second extension canal was sanctioned and executed for a length 1 mile and 2 furlong Santhan Eri to Sayakudi Eri and the IIIrd Extension Canal for a length of 1 mile and 1 furlong from Sayakudi Eri to Serandi Eri.
9. When the South Bank Canal was excavated and Kattalai Bed Regulator was constructed in the year 1934 - 1935 all korambu canals below Kattalai Bed Regulator upto Uyyakondan head from Pettavaithalai in Srirangam Taluk on the right side of Cauvery has been shifted to South Bank Canal and the required supply to Uyyakondan was drawn at head in South Bank Canal and let down at the tail drop in South Bank Canal into Kulithalai Kattuvari which joins with the leading canal of Uyyakondan just above the Page 25 of 47 head sluice a surplus escape was also constructed to facilitate letting out into Cauvery.
10. I humbly submit that Uyyakondan channel runs admittedly 8 km within the limits of Tiruchirappalli City Cororation comprising of K. Abishekapuram Zone, Ponmalai Zone and Sriyamangalam Zone.
11. I humbly submit that presently under AMRUT Phase II UGSS Project, UGD works are being executed from Puthur Weir upto Lawson‟s Road, near Ayyappan temple in Ponamalai Zone along the Uyyakondan channel bund side. Works are also being executed in Ariyamangalam Zone under this project along this channel bund. The sullage from Siddha hospital and TB hospital functioning inside the Government Hospital is connected with the sewer lines running in Allithurai road and the said sewage waters were stopped from going to the Uyyakondan channel. The sewage of Maruthi Hospital and Rathina Global Hospital located near Uyyakondan channel is not let into the channel and they have connected it in the UGD lines of this Corporation by following the said sewage line are connected to the Panjappur sewage treatment plant in Trichy.
12. It is stated that under the Smart City development scheme a plan to revamping the existing sewage system which are commissioned during the year 1987 were found out and a detailed study has been conducted and a proposal has been submitted for carrying out the said works. The said work was technically approved under the Smart City scheme and expecting the consent from the High power committee for carrying out the works at the earliest. The said proposal was submitted even on 21.7.2020 and will be taken on consideration within this month by the High Power Committee. Uyyakondan channel and its neighbouring areas are covered under the AMRUT PHASE - II SCHEME AND SMART City UGSS scheme. By completing the above schemes all the areas covered under the present Trichy Corporation limits will be connected to UGD scheme and no untreated water will be let out in Uyyakondan channel at all the 36 points mentioned above. The work is underway in Phase-ii scheme is already in the process for l9 points and balance 26 points will taken up in Smart City UGSS Scheme.
13. It is submitted that actions has been taken against the individual house hold who are not connected their sewage lines in to the existing UGD‟s. As such we found 1627 households in and around Uyyakondan canal were letting the sewage line in to the canal.

14. In the result of the action taken by the corporation out of 1627 total number of Households adjacent to the bank of Uyyakondan Canal, 1040 UGD Connections were given and 587 Public Health Notices are being issued to the individual households and 163 connections which are letting into Uyyakondan Canal were closed.
15. It is respectfully submit to state that the drainage lines in that area adjacent to the Uyyakondan canal were laid more than 30 years back and are now developing lots of stoppages and leakages around that area. Tiruchirapalli City Corporation are maintaining that old sewage system till now and now developed scheme under AMRUT PHASE - II Scheme till now and Smart City UGSS scheme for revamping the entire drainage and sewage system. After the completion of the above two schemes no sewage mixed water will be let in the Uyyakondan canal at any points.
16. It is respectfully submit that though 8 Kilometres stretch of Uyyakondan canal lines within the limit of Trichy Corporation, the weeds and Hyacinth were removed then and there by the Public [8] Works Department. Besides this action is taken against the individual households who are letting untreated sewage into the water body by City Health Officer of Tiruchirppalli City Corporation by way of issuing notice to stop such water contamination and to get UGD connection. Action is being taken in full swing to stop the untreated sewage water into the water body by Blocking the pipes which are directly let into channel  By issuing more notices under Public Health Act  By giving UGD Connections  Removing garbage from river bund using JCP and Tipper Lorry
17. Action is taken against persons who are responsible for the contamination of water by issuing notices by City Health Officer of Tiruchirapalli City Corporation as listed in the enclosure. Within the limits of Golden Rock Zone, by such action taken, Ward No.46, Ponvizha Nagar Bund side - 7 Nos. - Ward No. 48, Pakkali Street - 12 Nos. and within the limits of Ariyamangalam Zone - Ward No.21 - 15 Nos. Ward No. 23, Vaikkal Mettu Street - 32 Nos. & Eda Street South Corner - 85 Nos. Ward No. 22, Anna Nagar - 12 Nos. of households which are letting the waste water into the water body were found out and the same were stopped by giving connections to the UGD.

DISPOSAL OF SOLID WASTE

18. It is respectfully submit that in and around the canal the garbage„s gathered by the Corporation staff and cleared in alternative days. The garbage‟s and debris gathered on the banks of the canal are removed periodically by the corporation by using JCB, Tippers and dozer vehicle. In part of ARRUT PHASE - II scheme the said works are carried out on the banks are present also. Other than this process there is one Micro Compost Yard in Ward No. 49 Kulumikkarai, near Alwar Thoppu for proper processing and disposal of solid wastes.

RIVER FRONT DEVELOPMENT AT UYYAKONDAN CHANNEL Implementation of River front development project at Uyyakondan Canal is being executed at an estimated cost of Rs. 17.56 Crores to prevent canal pollution. Work under was issued to M/s. PST Engineering, Namakkal on 07.01.2019 and so far 60% of [9] work has been completed and total project will be completed on March 2021. (Photographs enclosed no: 72 to 76) Various entertainment in the name of Tiger Park, Peacock Park and Lotus Park are being created in the 2.10 Km stretch on both side of Uyyakondan Channel.

20. After the completion of project, Tiruchirappalli people will immensely benefit from the works executed here and they will enjoy very much with the entertainment structures created along with natural air.

The major Components of the project are follows:

Provision of RCC retaining wall in the project area, wherever necessary to sustain the improvements such as Walkways/Green Space/ Water front.
Development of Roads on both the banks of the proposed site to improve the mobility and connectivity.
Jogging, Walking and Pedestrian Pathways at the proposed site along the banks of the Canal.
Landscaping in the proposal stretch of the canal. Parking facility for people using river front facilities. Open stage with amphitheatre to conduct various shows at the bank of the canal.
Provision of E-Toilets.
Children‟s play area / play Equipment.
Public Park and Green Space development.
Seating arrangements for the visitors.

21. To prevent the pollution at Uyyakondan Canal, the Corporation decided to improve and develop the canal area under river front development component of Smart City Mission. The Corporation will conduct the awareness programme and displaying the boards so s to avoid the dumping of polluted things into the canal by the public.

Regarding discharge of sewage water from Annal Gandhi Memorial Govt. General Hospital, Tiruchirappalli:

22. I humbly submit that the Annal Gandhi Memorial Govt. General Hospital, Tiruchirappalli had submitted UGD application dt. 26.11.2013 with Tiruchirappalli City Corporation. A lr. Dt. 7.2.2014 bearing No.ROC No.E1/UGD/858, 860-865/2013 (K-Abi) was sent by the Commissioner of Tiruchirappalli City Corporation to the Dean, Annal Gandhi Memorial Govt. General Hospital, Tiruchirappalli calling upon to pay the necessary deposit amount and estimate and centage charges. It is stated in the said lr. About the collection toilet outlet of two wells is being pumped out and let into the existing UGD system available at Vannarapettai Road. In many occasion the UGD systems blocked due to huge quantity of sewerage disposal from the hospital. Resulting that the sewerage overflow through the manhole and lead into adjacent storm water drain. This storm water drain is having disposal point of nearby Uyyakondan irrigation channel and got polluted. Approximately 1,00,000/- ltrs of water is being used for flushing in the toilets attached to the Government Hospital.

23. I humbly submit that in order to avoid pollution of Uyyakondan Channel against UGD a proposal was given to give new underground drainage connections to the entire hospital premises through a separate 200 mm dia sewer main from the existing hospital outlet to corporation UGD sub-pumping station collection well which is located at Vayaloor Main Road at a distance of 1165 m. It results in free flow and disposal of sewerage waste from hospital. Frequent blockage in sewer main widely reduced and Uyyakondan channel safe guard against pollution It was also called upon necessary treatment system should be provided within the GH premises before let into corporation main. By that time it as estimated Rs.35,95,000/- to provide UGD connection to the Government Hospital.

24. I humbly submit that the Commissioner of Tiruchirappalli City Corporation had once again issued a Lrdt.24.5.2019 bearing Roc.No.UGD/858/860/2013/E1 (K-Abi) dt. 24.5.2019 to the Engineer-in-Chief, Buildings, PWD Campus, Chepauk, Chennai and to the Dean, Annal Gandhi stating the Page 29 of 47 revised estimate prepared for Rs.86.,00 Lakhs to execute the work and request to remit the amount for providing UGD connection to the Government Hospital, Farmers association have called for agitation to stop the missing of sewage water into Cauvery river on 27.2.2020. In a effort to solve the issue a Joint Peace Committee meeting was organised by the Tiruchirappalli West Thasildhar on 25.2.2020 for the purpose of providing UGD connection to the Government Hospital.

25. I humbly submit that in the peace committee meeting the Deputy Tahsildhar, Tiruchirappali West, Junior Engineer of K. Abishekapuram Zone, Tiruchirappalli City Corporation, RMO and Assistant RMO from Govt Hospital with other officers who had attended the meeting. In the said meeting it was resolved that Tiruchirappalli City Corporation has to provide UGD connection to the Government Hospital on payment of Rs.86 lakhs of estimated amount. The Government Hospital authorities assured to construct a treatment plant inside the hospital premises to a cost of Rs.1.5 Crores with the help of National Health Mission and they have sent communication to that effect to the National Health Mission.

26. I humbly submit that as per the 4th resolution of peace committee, the wastages from Government Hospital are divided into four kinds and they have to be sent to sengipatti at Tanjore District by the vehicle of a firm belonging to Medicane System for the purpose of treatment. The other general wastages are being removed by Tiruchirappalli City Corporation. The wastages collected from Isolation Ward and Surgery section are discharged only after treatment. In order to install the treatment plant inside the campus of Government Hospital a request was sent to National Health Mission claiming 1.5 Crore, the estimated amount.

27. I humbly submit that the Special Officer/Commissioner, Tiruchirappalli City Corporation had also sent a reminder to the Engineer-in-Chief, Buildings, PWD Campus, on 8.5.2020 to remit 86 lakhs to provide UGD connection to the Government Hospital, Tiruhirappalli. Once again a reminder dt. 4.9.2020 was issued to PWD calling upon to pay the estimated amount of Rs.86 lakhs for providing UGD connection to the Government Hospital, Tiruchirappalli. The Tiruchirappalli City Corporation had issued a notice dt 5.9.2020 to Government Hospital to discharge the wastage after treatment and called upon to stop the letting the wastage into the Uyyakondan Channel through the City Health Officer, Tiruchirappalli City Corportion.

28. I humbly submit that as the estimated amount is yet to be deposited and hence the UGD connection could not be provided by Tiruchirappalli City Corporation. Tiruchirappalli City Corporation has given a revised estimate for a sum of Rs.94.60 lakhs for laying separate UGD connection to the Government Hospital. It is reported by the District Collector that the proposal was sent for approval for the above said amount to the National Health Mission.

29. I humbly submit that totally there were 36 intersection points where the sewage water is flown into the Uyyakondan channel in the 8 km stretch. Out of 36 point now one point have been closed under the AMRUT-II scheme underground drainage system viz., Raja coloy ad Kumuli thopu area. Twenty six point will be curtailed in the ongoing Smart City UGSS scheme within 31.12.2021. Eight point where the sewage line connecting to Uyyakondan channel will be stopped on completion of AMRUTUGS PHASE-II before 31.12.2021 in which the work is under progress. Committee inspected at the points of SWD i.e., storm water drain on the way of Uyyakondan canal.

30. Timeline report for action plan Action has taken by Health Section by issuing 471 notices to close the outlet into Uyyakondan canal In consequence 38 UGD connections are given in the area within the limits of Ariyamangalam zone.

The reason for the delay in providing remaining 549 nos UGD connections to be given after revamping of main UGD pumping and distribution lines. This revamping work is doing under to heads viz., Smart City Mission and AMRUT UGSS (Phase-II) AMRUT UGSS Phase-II work is particularly in respect of the sewerage collection system in added and left out areas of erstwhile Tiruchirappalli City Corporation. Out o the added ad left out areas of erstwhile Tiruchirappalli City Corporation which are situated on the bund of Uyyakondan canal within 8 km are:

Lakshmipuram, Ammankulam, Seenivasapuram, Ganapathy Nagar, Kamaraj Nagar, John Nagar.
The remaining areas in UGD connections to be given which are under Smart City Mission are mentioned as follows: Lawsons Road, Ponvizha Nagar, Pakkali Street, Pudu Reddy Street, Alwarthoppu Main, Alwarthoppu 2nd & 3rd Street, Heber Road, Vaikkal Mettu Street, NM Pallivasal Street, Palakkarai Service Road, Eda Street, Nithyanandapuram, Irudhayapuram Thoppu Street, Mariyam Nagar, Duraisamypuram 1, 2, 3, 4 & 5 Streets, Dhanamani Colony, Manalvaarithurai Road, Valluvar Nagar, Page 31 of 47 Senthaneerpuram.
As there is no UGD Main is available in the areas which are covered under AMRUT UGSS Phase II scheme, UGD connections are yet to be given. 451 proposed manholes to be constructed for these areas. In which as on date 153 manholes work is completed. Out of 11.82 km length collection main, 2.69 km collection main line is laid. Out of 2.11 km pumping main, 1.16 km is laid.
In which areas lies under hard rock areas work will be executed only after getting permission of ADB as and when it requires to remove the hard rock locates in Lakshmipuram in ward no.7, Kamaraj Nagar in ward no.28 and Ganapathypuram in ward no28. This is the reason for the delay and this hard rock removing work is being done since past six months This UGD scheme work was started on 5.4.2019 and it is targeted to complete the work on 29.7.2021.

As far as Smart City Mission project for laying UGD connections are concerned, the following are the details of the status:

Project cost .. Rs.214.27 Crores Project area .. 11.82 sq.km No. Of wards .. 34 No. Of lifting stations .. 7 Length of pumping main replaced .. 6.20 km Length of sewer main replaced .. 210 km No. Of HSC connections to be replaced .. 55,155 As far as allotment of work under Smart City mission is concerned, this project was sanctioned by Smart City High Power Sanctioning Committee on 6.11.2020. After getting the technical sanction from the Chief Engineer, the Commissioner of Municipal Administration, Chennai tender will be floated with necessary procedures. Time taken for the above procedure will be 90 days to clear the activity before commencing the work. After revamping the sewer main, HSC connections will be given subsequently without delay, discharges letting into the channel will be completely arrested permanently. Until that time schedule, Corporation will control the discharges and insist the public to keep the disposal into the septic tank. So it will take approximately 90 days to complete all the procedures to commence the work. The period of project is 2 years.

31. I respectfully submit that this respondent is taking earnest steps to protect the water body situated within its jurisdiction without any default and complying with the environmental rules in letter and spirit and without any default."

12. Then, this Tribunal had passed the following order:-

"4. The report submitted by the Tiruchirappalli Corporation shows that certain works have been completed and they are utilising the funds available under the Smart City Scheme and AMRUT-UGSS PHASE - II Scheme and these works will be completed by 31.12.2021. But in the last part of the report, it was mentioned that the period of the project is two years.
5. It may be mentioned here that the discharge of untreated sewage into the storm water drain cannot be allowed to continue for two years as it may have impact on environment adversely. They are expected to come with a short term or temporary measure that is being undertaken by them to resolve the issue till the issue is permanently resolved by completing the underground sewage system utilising the funds available under the schemes mentioned above.
6. When this was pointed out, the learned counsel for the sixth respondent submitted that if some time is granted, they may be able to come with fresh report with short term as well as long term including temporary measures to resolve the issue till steps are taken to resolve the issue permanently.
7. The Pollution Control Board as well as the sixth respondent are directed to submit their further report regarding the progress of the work done and whether there was any improvement in the complaints made so as to resolve the issue and avoid pollution being caused to the storm water drain which ultimately reaches river Cauvery."

13. Thereafter, the case was posted to 24.03.2021 for consideration of further report.

14. On 24.03.2021, it was adjourned to 27.04.2021 for consideration of further progress report and thereafter, the matter has been adjourned from time to time by successive notifications and lastly, it was adjourned to today as per notification dated 16.08.2021.

15. We have received the present status report filed by the 6 th respondent dated 11.09.2021, e-filed on 12.09.2021 and received today which reads as follows:-

16. The Tamil Nadu Pollution Control Board/ 5th respondent also filed a report dated 11.09.2021, e-filed on 12.09.2021 and received today which reads as follows:-
                            "REPORT         FILED     ON       BEHALF       OF     THE
                 RESPONDENT -TAMIL NADU POLLUTION CONTROL
                 BOARD
I, R. Rajamanickam, Son of P.M. Ramasamy, Hindu, aged about 57 years, having my office at No. 76, Mount Salai, Guindy, Chennai -600 032, do hereby solemnly affirm and sincerely state as follows:
1. I am the Joint Chief Environmental Engineer, Tamil Nadu Pollution Control Board, Chennai and I am filing the Report on behalf of the Respondent Tamil Nadu Pollution Control Board and as such I am well acquainted with the facts of the case as per records.
2. It is respectfully submitted that the Hon'ble National Green Tribunal (Southern Zone) in its order dated 24.03.2021, has directed ineralia as follows:
"we feel that some more time can be granted to the Pollution Control Board as well as sixth respondent to file further report regarding the progress of the work done and also any improvement made in respect of the complaints made in the newspaper report and whether due to the work that has been done, any improvement has resulted in resolving the issue to avoid pollution being caused to the storm water drain".

3. It is respectfully submitted that in pursuance to the Hon'ble NGT (SZ), Chennai order dated 24.03.2021, the M/s. Mahatma Gandhi Memorial Government Hospital, Trichy, TS.No. 2, Block No. 8, ward No. Y, Puthur Village, Trichy west Taluk was inspected by the TNPCB officials on 05.08.2021 and 11.08.2021 and report is submitted as follows:

i. The Hospital has stopped the septic tank overflow discharge from 09-12-2020 onwards into the Uyyakondan channel.
ii. At present, the Trichy City Municipal Corporation is conveying the Septic tank over flow in their tankers to Trichy Corporation STP Pumping Station and treated in existing Trichy Corporation STP. The trade effluent generated from the hospital is disinfected using 2% sodium hypochloride solution before discharging in Septic tank over flow collection well in the Hospital.
iii. Laying of pipe lines for connecting to septic over flow collection well in the Hospital premises to the nearby Trichy City Page 41 of 47 Municipal Corporation's STP Pumping Station is under progress. It will be completed before 30-09-2021.
iv. During inspection on 05-08-2021 and 11-08-2021, no sewage is discharged into Uyyakondon channel. M/s. Mahatma Gandhi Memorial Government Hospital, Trichy has obtained consent under the Water (P&CP) Act, 1974 as amended and the Air (P&CP) Act, 1981 as amended valid upto 30-11-2021 and authorization under Biomedical Waste Management Rules, 2016 valid upto 30-11-2021.
vi. The Hospital is generating 3 T/day of Solid waste in its premises. Biomedical waste is not mixed with garbage generated in the hospital.
vii. The segregated biomedical waste is disposed to the CBMWTF M/s. Medicare Enviro System, Thanjavur on daily basis.
viii. No biomedical waste and solid waste is disposed outside the unit premises or in Uyyakondan Channel ix. The biodegradable and non-biodegradable solid waste are segregated and collected separately and disposed through the Local Body (Trichy City Municipal Corporation).

4. It is respectfully submitted that Trichy City Municipal Corporation is maintaining and collecting 390 T/day of Municipal Solid waste in all 64 wards after segregation as Bio-degradable and non - bio degradable waste. Bio-degradable wastes are composted in 36 Micro compost units - 180 T /day provided in Trichy City Municipal Corporation. 15 T/day Bio waste is treated by Bio methanisation process. 155 Tons/day of Plastic, Rubber etc., are sent to cement factories & recyclers; and 40 T /day of inert are sent for filling low lying areas. During inspection on 05-08-2021 and 11- 08-2021, it was found that no municipal solid waste is dumped in Uyyakondan channel.

5. It is respectfully submitted that, action is being taken against the individual households who are letting untreated sewage into the water body by City Health Officer of Trichy City Municipal Corporation by way of issuing notices to stop such water contamination and to get UGD connection. Action is being taken in full swing to stop the untreated sewage water into the water body by blocking the pipes which are directly letting into channel, by issuing more notices under Public Health Act by Trichy City Municipal Corporation and removed garbage from river bund using JCP and Tipper Lorry.

6. It is respectfully submitted that, even though action is being taken by the Corporation during inspection on 11-08-2021, it Page 42 of 47 was noticed that the untreated sewage are directly letting into Uyyakondan channel from several points from individual households and causing pollution and reduces the dissolved oxygen levels below 4 mg/L. Water samples were taken in the following areas and tested in the Advanced Environmental Laboratory, TNPCB, Trichy. The DO level in the Uyyakondan Channel is given below.

7. It is respectfully submitted that implementation of River Front Development Project at Uyyakondan Channel is being executed at an estimated cost of Rs. 17.56 Crore to prevent channel pollution. Work order was issued to M/s. PST Engineering, Namakkal on 07.01.2019 and so far 85% of the work has been completed. Various entertainment infrastructures such as providing three parks in the project area in the name of Tiger Park, Peacock Park and Lotus Park are being created in the 2.1 km stretch on both side of Uyyankondan Channel.

8. It is respectfully submitted that, to prevent the pollution in Uyyakondan channel, the Corporation decided to improve and develop the channel area under River Front Development component of Smart City Mission.

9. It is respectfully submitted that the Corporation has to conduct awareness program among public and erect display boards in the Uyyakondan channel areas to avoid throwing wastes in the water sources by the public.

10. It is respectfully submitted that during inspection, it was observed that there is no blockage in the Uyyakondan channel, due to solid waste and weeds and hyacinth. Various scheme works Page 43 of 47 are under progress in Smart City Mission and AMRUT UGSS by Trichy City Municipal Corporation. Until that time schedule, Corporation has to take action to stop the untreated sewage which are directly letting into channel and insist the public to maintain the septic tank with soak pit arrangements to control water pollution in Uyyakondan channel.

11. It is respectfully submitted that TNPCB has issued directions vide Proceedings dated 18.06.2021 to the Commissioner, Trichy City Municipal Corporation to comply with the following within three months, among other things:

i. The Municipal Corporation shall complete the underground sewerage system for the unsewered area and to ensure that the untreated sewage to assure 100% treatment of sewage.
ii. The Municipal Corporation shall expedite the process of sewer connection, construction, completion and commissioning of under construction STPs so as to bring them into operation. iii. The Municipal Corporation shall furnish time bound plan of action and show the progress made in the construction of proposed STPs so as to bring them into operation.
iv. The Municipal Corporation shall comply with the above directions within the time period specified therein. Otherwise Board shall impose Environmental Compensation as given below:
Environmental Compensation (EC) = Capital Cost factor x [Marginal Average Capital Cost for Treatment Facility x (Total Generation - Installed capacity) + Marginal Average Capital Cost for Convergence Facility (Total Generation - Operational Capacity)] + O&M Cost Factor x Marginal Average O&M Cost x (Total Generation - Operational Capacity) x Number of days for which facility was not available + Environmental Externality x No. of days for which facility was not available.
In this regard, reply has not yet been received from the Trichy City Municipal Corporation.

12. It is respectfully submitted that the Tamil Nadu Pollution Control Board will closely monitor the above works to be completed in timeline by the concerned departments to protect the Uyyakondan Channel.

Under the above circumstances, it is humbly prayed that this Hon'ble National Green Tribunal (Southern Zone) may be pleased to pass such order as it may deem fit and proper in this case and thus render justice."

17. The learned counsel appearing for the Thiruchirappalli Corporation submitted that smart city project in which certain work will have to be undertaken in connection with this was approved in May-2021 and they will be able to complete the work by end of May-2023. Considering the fact that significant progress has been achieved by the Thiruchirappalli Corporation for the purpose of resolving the issue and though not fully completed as seen from the report submitted by the Pollution Control Board, instead of keeping it and monitoring the same, we feel that the matter can be disposed of by giving directions to the regulators to take appropriate action to file progress reports to this Tribunal.

18. So, this application is disposed of as follows:-

i) The Thiruchirappalli Corporation is directed to expedite the implementation of the Under Ground Sewerage System (UGSS) and other schemes which they proposed to launch for the purpose of resolving the issue permanently under the Smart City Scheme and AMRUT Scheme and they are directed to complete the same within time frame fixed as quickly as possible at any rate not beyond the time fixed by them namely, May 2023.
ii) The Thiruchirappalli Corporation is directed to file their periodical as well as progress reports before this Tribunal once in 6 (Six) month.
iii) The Tamil Nadu Pollution Control Board is also directed to conduct periodical inspections and if there is any gap found regarding the implementation of the Solid Waste Management Rules, 2016 and implementation of the directions issued by the Principal Bench of National Green Page 45 of 47 Tribunal, New Delhi in O.A. No.606 of 2018, then they are directed to take appropriate action against the violators, including the Thiruchirappalli Corporation for non-

implementation of the Solid Waste management Rules, 2016 and file a periodical reports to this Tribunal once in 6 (Six) months and while filing such reports, they are expected to file the status report regarding the quality of the water in the canal and also implementation of the Solid Waste Management Rules, 2016 and Bio Medical Waste management Rules, 2016 by the Corporation as well as by the Healthcare units and the action taken for violation periodically.

iv) The Additional Chief Secretary, Municipal Administration and Water Supply is also directed to monitor the progress of the work personally and see that the schemes are implemented as quickly as possible and at any rate within the time frame fixed namely, May-2023 and also file independent report to this Tribunal once in 6 (Six) months regarding monitoring and implementation of the schemes in the Thiruchirappalli Corporation.

v) The District Collector is also directed to monitor the progress of the work and submit an independent report to this Tribunal once in 6 (Six) months regarding the progress of the work and action taken, if there is any violation found against the violators.

vi) The Public Works Department is also directed to monitor the flow of water in the Uyyakondan canal during irrigation Page 46 of 47 season and see that unpolluted water reaches the ayacut areas and if there is any encroachment and other impediments found, then they are also directed to take appropriate steps to remove the same and protect the purpose for which the canal has been constructed by our forefathers.

vii) The Registry is directed to communicate this order to the Chief Secretary, State of Tamil Nadu, Additional Chief Secretary for Municipal Administration and Water Supply, Principal Secretary for Environment, Director of Municipal Administration, Additional Chief Secretary for Public Works Department (PWD) & Water Resource Organization (WRO), Commissioner, Thiruchirapalli Corporation, Chairman, Tamil Nadu Pollution Control Board and also to the District Collector, Thiruchirapalli for their information and compliance of the direction in its letter and spirit.

viii) The Office is directed to place the report before this Bench as and when received for further consideration and issuance of further directions (if any) required in this regard.
