1. This Chamber Summons seeks amendment to the schedule of a disposed of Testamentary Petition, in order to enable the petitioner amendment to the Schedule in the grant which was issued on 15 th December 2018 The affidavit in support sets out that there are other assets of the deceased by way of fixed deposit in two banks who are impleaded as respondent nos. 1 and 2 to the Chamber Summons. These were not to the petitioner's knowledge when the petition was filed.
2. In view of the averments in the Affidavit in support of the Chamber Summons and the submissions made on behalf of the applicant, I pass the 1/2 41-cstl-188-2019.odt following order :
(i) There will be an order in terms of prayer clause (b).
(ii) Affidavit in reply to be filed within two weeks of service of authenticated copy of this order upon the respondent.
(iii) Stand over to 5 th August, 2019.
