This is an application under section 11 of the Arbitration and Conciliation Act, 1996, for appointment of an arbitrator.
Admittedly, there exists an agreement between the parties which contains an arbitration clause. Learned counsel for the parties do not dispute that this Court may appoint an independent arbitrator to settle their disputes and differences.
Considering the facts and circumstances, I hereby appoint Justice V.N. Khare, former Chief Justice of India, as the sole Arbitrator. The parties may approach the learned Arbitrator at the earliest at his convenience and request him to enter into reference and decide the dispute as expeditiously as possible. The fee, etc. shall be as may be settled by the parties with the learned Arbitrator.
