1. By way of this petition through jail, the petitioner-convict has prayed to release him on parole leave for a period of twenty days.
2. Heard.
I have perused the relevant record. The convict is sentenced to undergo imprisonment for life for the offence punishable under Section 302 of the I.P.C.. From the record it transpires that the convict was released on parole leave for a period of three months on 13.12.2005 and he had to surrender before the jail Authority on 12.0.3.2006, but, he remained absconding for a period of 511 days i.e. till he was caught by police on 05.08.2007. Mr. Raval, learned APP has submitted that the appeal preferred by the convict challenging his conviction being Criminal Appeal No.726 of 1998 is dismissed by the Court on 04.04.2007. By way of this petition, the convict has sought his release so as to enable him to attend the after death ceremony of his sister.
3. Taking into consideration the aforesaid facts, Superintendent, District Jail, Jamnagar ought to have send this application to the competent Authority / Court for taking necessary actions. However, Superintendent, District Jail, Jamnagar directly send this application to the High Court at Ahmedabad. Hence, Superintendent, District Jail, Jamnagar is directed to send this application to the competent Authority / Court for taking appropriate action.
4. With the above direction, the petition stands disposed of.
