3. During arguments, our attention was also drawn to the orders passed on 28.07.2017 in Writ Petition No. 994 of 2017. One of us (B.P. Dharmadhikari, J.) is party to that order. We need not delve more on this order because para 7 therein shows that the concerned School had started receiving 100% grants from the year 2015-16.

Here, the Schools, about 148 in number in different parts of the State of Maharashtra, were permitted to upgrade to a Junior College by assuring them 100% salary grants, non salary grants and also assistance to the students staying in hostel. This decision was taken in the year 2008 and then Schools were given to understand that in initial four years they would not receive any assistance. They were entitled to receive ::: Uploaded on - 17/10/2018 ::: Downloaded on - 17/10/2018 23:30:43 ::: wp5991.16 49 25% grants in the year 2012-13, 50% grants in the year 2013- 14, 75% grants in 2014-15 and 100% grants in 2015-16. This decision was modified to the prejudice of the Schools and employees, on the ground that necessary previous sanction of the Finance Department was not obtained.
5. Again because of recent decision dated 03.08.2018 taken by the State Government, this history is not necessary. The earlier Government Resolutions dated 26.06.2007, 26.06.2008 and 31.08.2009 are restored except the provision therein for non salary grants. With the result, the petitioners become entitled to stage-wise increase in receipt of salary grants as mentioned supra and to 100% salary grants from the year 2015-16.

This Court has in all these matters, after hearing all concerned, directed the State Government to disburse 50% of the amount of salary within the stipulated period and to continue to pay their regular salary. Thus, those whose appointments were approved and are working on sanctioned ::: Uploaded on - 17/10/2018 ::: Downloaded on - 17/10/2018 23:30:43 ::: wp5991.16 50 posts, got 50% arrears and also getting regular full salary because of court orders.

The learned AGP, in this situation, has submitted that considering the magnitude of problem, the court orders and the interest of students, State Government has on 03.08.2018 taken a suitable decision. She further submits that insofar as arrears are concerned, the State Government is holding an inquiry to find out whether the Schools which are given benefit are entitled to it as per law. This direction is by the Finance Department. She seeks time of one year to complete this inquiry. According to her, after completion of this inquiry, balance amount of arrears shall be released to eligible Schools and employees.
8. The respective counsel for the petitioners point out that out of total 148 Schools, only few Schools in the State of Maharashtra have not received the complete amount of arrears. They submit that the Schools in excess of 100 have already received full arrears also and as such by subjecting only ::: Uploaded on - 17/10/2018 ::: Downloaded on - 17/10/2018 23:30:43 ::: wp5991.16 51 remaining Schools to scrutiny, an artificial discrimination is being made by the State Government. They contend that when counter parts of the petitioners have received full arrears, subjecting 50% arrears of the petitioners to such scrutiny will be arbitrary.
9. The arrears are not released because of interim orders passed by this Court. This Court then ordered only to release 50% amount of arrears but then also directed full salary towards current work. The facts also show that without necessary previous approval of the Finance Department, the Schools have come up and financial burden has been cast on public exchequer. The decision of the State Government to hold an inquiry, therefore, cannot be assailed as unwarranted. The State Government does not plan to hold inquiry only against Schools where arrears are still to be paid, inquiries will be held against all 148 Schools. If the Schools are found established contrary to legal provisions, definitely State Government will be entitled to take necessary steps as per law. We cannot at this stage observe anything more in this respect. ::: Uploaded on - 17/10/2018 ::: Downloaded on - 17/10/2018 23:30:43 ::: wp5991.16 52 If such action is taken, the petitioners before this Court will also be entitled to raise appropriate defences at that juncture.
10. As the inquires are being conducted against all Schools, we find no artificial discrimination being made. Few employees because of intervention of this Court or otherwise got benefit of 100% arrears, the others will get balance arrears after the inquiry is over. On their right to receive such arrears, again we need not observe anything more as it may or may not be contingent upon the outcome of such inquiry. The issue will be required to be decided at that stage after finding out the mischief played. The decision has been taken by the State Government on 03.08.2018 and the issue is pending since the year 2015. We, therefore, grant the State Government time till 31.03.2019 to complete the inquiry. If the inquiries are not so completed, balance 50% amount shall be released to other petitioners immediately thereafter.

We also grant the petitioners leave to approach this Court after receipt of such amount or after 31.03.2019, as the ::: Uploaded on - 17/10/2018 ::: Downloaded on - 17/10/2018 23:30:43 ::: wp5991.16 53 case may be. If they are required to approach this Court again, their right to claim interest on the amount which has been received by them belatedly, will be considered at that time.
12. During arguments it was pointed out to this Court that because of pending litigation, salaries were being disbursed off-line. We find it in the interest of employees and also administration that such salaries are henceforth paid directly on-line and the amount is deposited in the bank account of the respective petitioners.
13. With these directions, we find that other grievance of the petitioners are redressed because of Government Resolution dated 03.08.2018. Accordingly, we make Rule absolute and dispose of the petitions. However, in the facts and circumstances of the case, there shall be no order as to costs.
